I also question the constitutionality and wisdom of having civilian court judges attempt to rule on what is essentially military conduct rules
??? Are you saying that you are questioning the wisdom of checks and balances, because her ability to do this is not in question.

Not by anyone who knows anything and that doesn't have an agenda. :) I just got out of 2 hours of civil procedure where we discussed the ruling.
To paraphrase my professor...this illustrates the beauty of injunctions. You must use them wisely, but as an attorney (or a judge), you can shut a business down by getting one.

Watch the YouTube video that I posted and listen to the testimony of the senior military officer. He says that he and John McCain have always known they they served with gay people. The evidence (to them) suggests that it is not disruptive. The U.S. military has never been without gays.
Also, many Western countries allow gay people in their military. It hasn't been an issue.
DISCLOSURE: My position is simple. I wan't the best military in the world. I don't care what their sexual orientation is. I want qualified people. It's a volunteer force and don't want to discriminate against qualified people.
I Wow Woods, for many reasons. San Francisco?? How cliche can you get? What exactly is "acting out openly gay"?? And as for conduct, isn't there a code of conduct for all soldiers? There are women who serve now, this is not specific to homosexuals. You may recall some serious issues regarding heterosexual misconduct. Address improper behavior, not orientation.

The Justice Department has asked a federal judge to allow the military's "don't ask, don't tell" policy on gays to continue during an appeal.
In court papers, the Obama administration says the case raises serious legal questions and that the government will be irreparably harmed unless the current policy is allowed to remain in place temporarily.
The Justice Department action came two days after a judge in California ordered the Pentagon to cease enforcement of its policy barring gays from openly serving in the military.

My husband is retired Army, he doesn't see a problem with gays in the military at all and thinks DADT is a horrible policy. Imagine having to keep a big part of your life a secret, or face losing your career. Imagine giving your life for your country, never having been allowed to be open about your orientation. It's a head in the sand approach that doesn't work and fosters hypocrisy and lies.
Perhaps there are other area's that a gay can serve our country in, like being President for example.... I'm sure a gay President or Vice President would be fine. Wouldn't it be lovely to see a gay President and his boyfriend move into the White House?
