    CLEVELAND (CN) - A baker who refused to decorate Christmas cakes claims in court that his boss fired him because he's a Jehovah's Witness.
    Charles DiGiorgi sued Dave's Supermarket in Cuyahoga County Court.
    DiGiorgi claims Dave's hired him as a baker on Dec. 14, 2011.
    On or about Christmas, he says, "Dave's discovered the fact that DiGiorgi is a Jehovah's Witness.
    "Dave's learned that DiGiorgi is a Jehovah's Witness because, pursuant to his religious beliefs, DiGiorgi did not decorate Dave's Christmas cakes.
    "Dave's also learned that DiGiorgi is a Jehovah's Witness because he did not attend the company Christmas party."
    DiGiorgi claims Dave's retaliated against him for his religious beliefs by transferring him, on Jan. 8, 2012, and firing him on Jan. 21.
    He claims that when he asked why he was being fired, a Dave's boss told him: "You know why."
    He claims he was fired because he's a Jehovah's Witness.
    He demands more than $25,000, and punitive damages, for discrimination, wrongful firing and intentional infliction of emotional distress.
    He is represented by Brian Spitz, of Euclid, Ohio.

    yep, he will lose. My Dad once refused to fix telephone line inside the church. When he talked to an elder about the situation, he said it is okay to do that. He said if the church was on fire, jw fireman have no choice but to take the fire out.

    Hey I had a dub sue me for religious discrimination once. Yep. While I was an active witness. I showed the judge my blood card. "Dismissed"

    He got cut loose cuz he was slacking off during a busy season and expected to get paid.

    He lost the job because he refused to do the job. A cake decorator who refuses to decorate cakes for religious reasons? Why would he take such a job in the first place? If he won't decorate Christmas cakes, what about Easter, Halloween, Birthday cakes, etc? Will he refuse to decorate a same-sex wedding cake? What part of the job WILL he do? When do JWs ever purchase decorated cakes? Aren't wedding cakes rooted in paganism? Wouldn't a graduation cake be an unacceptable "worldly celebration" of Satanic, secular education? Jesus never miraculously provided cake at any time, he stuck to bread and fish!

    It's one thing to say, "I'm being harassed because of my religion," if he was fired for refusing to attend the company Christmas party. It's something entirely different to say, after you've been hired, "I refuse to do many parts of my job because it's against my religion." So the business must keep this slacker on the payroll and hire another person to do his work?

    Yea I agree Billy. It's not a secret what a cake shop does during the holidays. Did he refuse to decorate borthday cakes? That has to happen weekly.

    One major problem that dubs set up, is that they don't do any pre-planning. My SIL is an architect and she told them up front what her limitations were. There was only one job that made her feel uncomfortable, and that was designing the exterior of a church. One job and it was easily reassignable.

    But to sit down and cross your arms at the last second, basically holding the employer hostage, is selfish and displays a lack of consideration of other religions, while at the same time, demanding considration of his own religion.

    Now the dub has unemployment for income, and a record of insubordination in the workplace. Nice going.

    I would guess that at least 75% of the work for a cake decorator would be holiday items and birthday items, unless you worked in a shop that specialized in wedding cakes only. Most supermarket bakeries don't do a lot of wedding cakes. What did he really think he'd be doing?
