What a scam. Take a job that you know will conflict with your religious beliefs then claim discrimination. Probably hopes he can full time pioneer for awhile on the settlement. This cult is so ridiculous. Change major doctinal beliefs at the whim of their Governing Body, but still hold onto decorating Christmas cakes is bad petty beliefs. So glad I am out of this stupid cult.

I think he has a warped idea of what the word work means. I would suggest he took the job under false pretenses and misled his employer. He claimed to be a cake decorator when in fact he was only able to decorate a limited number of cakes. He would have known that there would be an expectation to produce finished cakes for a number of occasions but also knew he would not be willing to decorate any of the seasonal items.
What is annoying is this person took the job away from someone else who would have been willing to work and who would have been able to have a good christmas themselves with a wage coming in.

There are times when JW's are mistreated in the workplace and should take legal action but don't because they want to be a good example.
I remember in the late 1980's when my lovely Mom was in her early 50's and learned how to drive and got her first job ever as a Bank Teller. Although she looked like a film star, she never had enough confidence in herself or appreciated how smart and talented she was. Getting this job was a big deal. She was excited, scared and unsure all at the same time. We were all so proud of her. She had come to this country as a young woman with two children to care for, then later had two more, consequently she had never had a job outside the home before. Up to that point, she had only taken care of us and was an Aux.Pioneer. It was during the holidays when she started her new job. Wouldn't you know, right off the bat, the Woman Manager put her in charge of decorating the giant Christmas tree in the lobby of the bank. Of course poor Mom had to take a "stand" for Jehovah, when all she wanted to do is fit in at her new job and not cause any problems. The Manager was angry....couldn't stand JW's in the first place, now she had one working for her. She was rotten to Mom from then on. She'd come home in tears in the evening overwhelmed by what she had to learn as well as the way she was being treated. After the Holidays, the Manager announced in front of everyone that since Mom didn't help with the decorating, she could be the one in charge of taking them all down. Mom climbed a ladder in a dress and took down all the lights and decorations by herself and packed them up. She was then instructed to take the 20 foot tree down and drag it out of the lobby into the parking lot. Mom was an elegant and dainty woman and the tree was too heavy for her to manage and it came crashing down on top of her causing a big scene. The other women wanted to help but the Manager wouldn't let them. Mom managed to slide the tree across the marble floor then wrestle it halfway through the lobbies double doors, but it became stuck as the branches were too wide to fit. The customers and other employees were looking on as she struggled with it, she was embarrassed, her back was aching, she was sweaty and her hair was "all aske" as she later described it. Understandably,she became overwhelmed and then eventually, just plain angry. She went over to her desk, got her purse and ran out to her car and drove home in tears. Later the Manager drove over to our house, fearing that she'd be sued, I'd guess, because she apologized and begged Mom to come back to work. In a Christian manner,so as not to bring further reproach on the organization , Mom declined.
When we all got home that evening and saw her so upset ,feeling like a failure and heard what happened, my non JW Dad and us kids wanted revenge. But as always, she made us do the right thing. Mom never had the courage to try getting another job and broke our hearts when she died about two years later from Cancer. Oh how I'd have loved to know who that Woman was who was such a bully to my Mom....that would never happen today.

DiGiorgi claims Dave's retaliated against him for his religious beliefs by transferring him, on Jan. 8, 2012, and firing him on Jan. 21.He demands more than $25,000, and punitive damages, for discrimination, wrongful firing and intentional infliction of emotional distress.
First thing, why take the job just before the Christmas period.
Second, is there no such thing as a trial period, which can legally last one month and extended for a further month. During this period the job can be terminated, no reasons asked. Claiming such damages when technically still in a trial period, there just isn't a case there.

Wha Happened, there is no unemployment compensation in Ohio for people who are fired, unless it can be proven that the firing was unreasonable. For example, I've only been fired from one job. The reason was because my employer discovered that I was looking for another job closer to home. I was permitted to draw unemployment.

Applying for the cake decorating job in the middle of the busiest time of year for Christmas decorations is willfully walking into a conveniently religiously-constructed conscience minefield.
Did he have the professional courtesy to advise his prospective employer during the interview that he was a JW and would not decorate a high percentage of cakes? I doubt it - he wanted the job.
Some professions have "vexation" written all over them for the religiously minded. Cake decoration??? It would be interesting for the media to interview this undoubtedly sincere but self-entitled cake decorator to find out how he would make a living at the best of times, given the significant level of work that results from "pagan" festivities, christenings, birthdays, to say nothing of non-Christian religious festivities (e.g., Hindu) that involve colorful cake decoration.

I think both parties are possibly at fault to a degree, more so the JW. For one thing, if the JW was hired 12/14/2011, that's in the middle of holiday season. That said, he should have relayed to his potential employer that he was a JW from the get-go as it would affect his job duties. Every job interview I've ever been on there was detailed discussion about what was to be expected of me if hired. If decorating cakes was part of this baker's duties and there was going to be an issue, he was obligated to tell his potential employer what he could and could not do. I'd love to know if this JW was a born-in too considering all the material the WT has produced throughout the years encouraging JW parents to speak with teachers about the "special needs" of their children and to do so WELL BEFORE holidays or other situations come up. I was offered a job to work at a plant that manufactured all sorts of things, some of which were for the military related. During the tour of the place, my potential employer couldn't even take me throughout the entire facility because some of the work was classified. After he made the offer, I told him that I couldn't work on certain projects due to my JW beliefs, and he was ok with that as they had plenty of other projects going on other than military related.
That said, the link states that the JW was transferred on 1/8/2012, and then fired 1/21/2012. I'd love to know what transpired during those two weeks. Reflecting on my behavior at an old job, in hindsight I would have conducted myself differently. I was completely unyielding in certain situations related to being a JW and came off like an arrogant pious prick. One situation, pizza was ordered by segment of our department for the whole department, and my boss approached me to let me know that it wasn't related to Christmas. But arrogant pious asshole me allowed the holy spirit to see it for what it really was. Yep, Christmas pizza disguised as a generalized appreciation lunch!! Not only did I decline to eat any of the pizza, I went down the street and got some hot dogs and also had the nerve to come back to work and eat the hot dogs at my desk like I was rubbing it in their faces letting them know just how righteous I am. Little things like can make you look like the biggest jerk. I got sick off those same hot dogs later too, and deserved every bit of stomach woes from that situation.
That's why I wonder what happened during those two weeks. The JW probably conducted himself like a self righteous prick, probably badmouthing the boss and politicking despite having only been working there a month and a half. It's possible the boss could have been more yielding, but maybe he was when he transferred the JW. Who knows.
