Judge asked: What is WTS's fiduciary relationship with Vicki?
Mr. Mark answered:
- she did as she was told - she acctepted this as it was taught to her from her youth-she relied on them
- she was brought up to believe that the curch is what counted and that the world
- would be rejected by God
This is when the Judge asked: "Does everything a church does to a person make them responsible for the damage? If one is willing to go through it, how is it their responsibility?"
Mr. Mark answered with an example of the WTS's responsibility in the effects of their punishment as in the Moyle case in Rutherford's time. The WTS had to pay damages for their actions.
From the past reading I've done - it's been extremely hard to prove a fiduciary trust between elders & followers or between the WTBTS and followers. If it can be accepted in this case.....the fallout will be interesting - I don't think that door's been opened before this.
I was in a court case not too long ago. Completely frustrating - perhaps it's universal that the lawyer never thinks exactly as we want him to think?
I know a couple of good (even excellent) lawyers. When I've talked about the WTBTS - they just can't comprehend the jw mind. A situation was run by a strick Jewish lawyer......and he understood exactly what the fiduciary trust was between the WTBTS and it's followers. But proving it - now that's another thing.

My thoughts were that using the WTS's own literature may have made it clearer for the Judge to see where fiduciary trust begins. Those raised as JWs and converts, have no other input but that of the constant barrage of what we are expected to do to show our loyalty to God and its made very clear in black and white in their literature that we are expected to obey the elders and the GB through the pages of the literature.
However, I don't know of anything other than Dr. Penton's and Barbara Anderson's reports were entered as evidence, but hopefully they will be able to make that relationship clearer to the Judge.

This is bang on target, and the real crux of this case in relation to the big picture. IMO, I think it is why the WT has been so aggressive about settling out of court with gag orders. They know that if just one case establishes fiduciary trust, they will have an avalanche of claims to deal with. Thus, they have to keep winning cases just to maintain the status quo, but victims just need to win one to open that door.
