I'd just like to add, there are some elders that do act in a fair manner and do everything they can to deal with the publishers in a loving way and according to conscience. I've known many and there are even a few of them here.

What happens if you draw 2 "rush to judgment" elders and 1 "let's err on the side of mercy" elder? What happens? Do the other 2 wear down the 1 elder? Does the 1 finally give in to the other 2 even though he really feels the person is repentant? How does that 1 brother justify it in his heart?

The elders are supposed to do all things "in agreement" and "with one accord". So if an elder is in a minority position on a decision, he is generally expected to "keep peace" and yield to the majority.
So in your scenario (2 judgmental elders against 1 reasonable one), the majority rules!! That's theocracy for ya!!

This kind of reminds me of how medieval Europe determined who was a witch. They would throw the accused into deep water. If she floated, she was guilty. If she drowned, then she was innocent. Oy vey!
You must remember that if the PO is sharp, he will see to it that the right commitees are selected. Usually the PO and another astute elder will work the body to make sure the correct results are attained.
