    I totally empathise with you, because I've had to deal with insurance companies before, and I know what it's like to be short on cash and having to deal with other debts, other commitments etc. Yes, you may end up being screwed, but before you sign anything, before you accept any settlements, look into the options the others have mentioned, such as getting legal advice, and going to the small claims court to sue the idiot who totalled your car. And make sure the insurance company doesn't try to intimidate you into anything!!!

    Sorry that you are in this situation. It sucks, but it does leave you more informed for the next time you insure a car. Sometimes life teaches us lessons the hard way.

    I want to thank everyone for their advice. For those of you that said that I should sue the guy; don't worry, that was my first thought anyway.

    Good idea actually. He even had a truck, so if that worked out, we'd have a perfect moving vehicle.

    Girl you must think I'm crazy! There is no way I'd tell them that my car really was a piece of crap. I'm a strong person, and I'll fight for the best deal, trust me. As for being in Florida in 6 weeks, I doubt that; but we should still be down there before summer is out.

    Everyone should ALWAYS have GAP insurance.

    UNLESS, your regular insurance will cover the balance owed on the car. Usually, they do not.

    Gap insurance, purchased when you buy your car, will pay the difference of what your insurance company will cover and will also cover deductable when your car has been totaled or stolen. They will also negotiate directly with your insurance company in the event something happens.

    For example, lets say you owe $10,000 on your car. It gets totaled in a accident, and your lovely insurance company tells you that they think the car was only worth $7,000. Plus, you have a $500 deductable. Therefore, before you do anything, you are $3,500 in the hole, before you even start to think of getting a new car, and trying to get a down payment for that too.

    Gap will cover the complete $3,500 so you can just worry about getting a new car. AND, some Gap companies will give you up to $2,000 for a down payment on another car.

    Just a tip for those buying cars in the future.

    SP, I'm sorry this happened to your car! My daughter was in an accident about two months ago, but that situation was much easier to sort out. Also, my car was rear-ended a few yrs back (on the way to a Circuit Assembly) and that situation was also much easier sorted out than yours.

    Reading the replies, which are all helpful, I'd say that XenaW has the right idea, and also that getting legal advice (which hopefully won't just add to your burdens expense-wise) is also a good idea.

    Umm, if I had that insurance there wouldn't be a problem. I only learned about GAP insurance yesterday after all of this happened. It's too late to worry about that though.

    The only that I can think to do is to sue the guy that hit me, but that'll significantly delay my move. Oh, well. . .

    The restaurant that I work for has this program where they take a dime out of each employees paycheck and it goes towards someone (another employee) who's in need. I doubt my situation is bad enough for this assistance, but I'm going to see if they can help me.
