Well, with the latest win in Canada, they could set up a fire, dance in circle around it and pronounce you disfellowshipped, the law will not intervene.
People should focus on the enforced shunning, not the internal inner workings of the organization.

If you are referring to the Df'd real-estate agent who lost his action against WT for effecting his ability to earn a living, that was IMO the correct outcome. A JW real-estate agent should not be relying on JW's as clients to provide his income.
The OP refers to representation or an advisor being present during a JC 'hearing'. As implied in one of the responses, if you don't want to hear the answer, don't ask the question. If asked if a lawyer or other representative may attend, elders will say NO.
As the person on trial and you wish to take some control, you then tell the elders in writing your conditions and requirements for you to attend a JC hearing. It then becomes their decision if they will comply to your requirements. If they do not wish to comply, they may drop the matter or they could proceed to DF you without you being there.
It's WT's club. WT sets the rules and conditions for membership. If you no longer wish to adhere to those requirements, they are within their rights to remove you from membership. To reduce legal action due to defamation or slander, real or implied, any announcement no longer states a person was removed (DF'd) or any reason, but only advises the congregation that the person is no longer a JW.
I know a brother who is a lawyer, was an elder, and was adulterating with another sister. There was a judicial committee. He didn't get df'ed but rather got a free pass so he divorced his wife and marry the bangee!
It was big news in the San Jose CA area for a while. Our guess is that he scared the committee with legal action.

I'm from that area was a JW till 2001. Went to the KH on clayton street was a a new boy to the area came there about 1993.
Any formalized society is a club for socializing, for companionship or camaraderie. It may be a tennis club or Hells Angel or church group because humans essentially enjoy keeping company with those who share a similar world view, those of like mind. These social pools are where we find friends and partners.
Jehovah’s Witnesses join their paranoid club knowing well the rules-- and breaking the rules of any society has penalties.
To attempt to bring a lawyer to a judicial hearing would only enhance legitimacy of the of the tribunal. It has no legal basis in the first place hence a lawyer would rarely if ever be appropriate.
JW ‘judicial’ committees are there to enforce cult thinking and keep external influences from seeping into the religion which would otherwise weaken and dilute its power. Strict boundary marking makes for a strict cult identity and JWs are taught to be comfortable with clear boundaries, this is one of the appeals of any cult, you don’t have to think hard because the contrived rules are simple and strict. Real life is quite different!
If you deliberately break JW rules you are in effect saying you disagree with the cult. Would not the best policy then be to leave without attending the humiliating mock trial and thereby make the statement, so to speak, that you do not recognize the authority of the religion.
The JW religion functions by infantilizing all of its members, disagreement is not permitted and ritual adulation of the governing body and its role is encouraged. To strike out against this perceived authority is often the first step in personal responsibility by taking matters into your own hands and using your human birthright to choose your own path in life.
Remember this; to leave the JW organization is one of the most liberating experiences in life!
