I believe the Articles of Impeachment need to presented and voted on in the House while the individual is still sitting as president. Once that happens the Senate "trial" need not occur during the actual term of office
Do You Support Trump Being Impeached Again?

So then any other individual "President" who incites insurrection directly against the US government while being the acting president, should receive no blame, guilt or responsibility, in spite of occurring deaths and violence to those who happen to work at the Capital buildings at the time, including security ???
Somehow that just doesn't seem fair or equable ???

Just to clarify D Trump was still the acting president under oath on Jan.6 , the day of the violent insurrection.

@Rocketman123:
No, there is a distinction in purpose between an impeachment and criminal trial. Impeachment is about removal, not about assigning guilt. You can't indict the President, so you impeach him to remove. After that, he can be criminally charged. In other words, double jeopardy doesn't apply to impeachment.
Also, he didn't "incite" and "insurrection", unless you expand your definition of "incite" and "insurrection" so broadly that it would literally include every Democrat in office today. I suspect you wouldn't want that.

Trump did not incite an insurrection against the US government. But if you want to believe that he did there is no way to convince you.

18 U.S. Code § 2102.Definitions
(b)As used in this chapter, the term “to incite a riot”, or “to organize, promote, encourage, participate in, or carry on a riot”, includes, but is not limited to, urging or instigating other persons to riot, but shall not be deemed to mean the mere oral or written (1) advocacy of ideas or (2) expression of belief, not involving advocacy of any act or acts of violence or assertion of the rightness of, or the right to commit, any such act or acts.
The FBI had intel published on January 5, 2021 that there were people coming and planned on carrying out acts as seen on January 6, 2021. Excluding those individuals, were other people who came to the rally on January 6, 2021 incited by that rally to riot? That is the accusation which requires being proven by evidence.

He was overwhelming found guilty of the act in both the Congress and the Senate but there wasn't enough votes to uphold the Constitutional impeachment which needs 2/3.
Doesn't really matter, the man's political career is over.

Which is what most Republicans secretly want!
