Yes, I believe it is possible but have not heard of any specific instances. Most of these types of cases never make it to trial. They get settled out of court. That is why they changed things a few years back( 88-89 i think). They forsaw all the upcoming trouble, especially with the abuse cases and started to disavow having influenced anything from a judicial nature. By having that seperation they are trying distance themselves from these type of issues.
They will try to help when an elder has to go to court because they don't need him saying something that will get them into trouble. By offering help on the side, they are helping themselves. They need to keep very clear the boundries of eccliastical privledge in court. This is why they will join with other religions in appeals on various issues (like taxes) because it is in their own best interests.

Min, at that elders' meeting with the District Overseer, did you come away with the impression that the Society was prepared to back up the locals to the hilt even in the case of an incompetent elder commits an egregious abuse of power because a WTBTS policy directive was ignored? What does their admonition to always stress that it's the local congregation NOT the WTBTS that disfellowships someone when making the public announcement, or for dubs NEVER to say when going door to door that they ``represent the WTBTS?"
It's reminiscent of Tonto's retort to the Lone Ranger when the latter exclaimed: ``Tonto, we're surrounded by Indians!'' To which Tonto replied: ``what do you mean `we,' white man?
Elders, watch your backs!

Room----I know what you're saying and I remember how the DO joked about how the Society was ditching the elders with the crap that might fly. But I know of no action where elders were independently sued. Do you? Believe me, if it's happened, we all would've heard about it.

Min, you know you may have hit upon something! As a strategy maybe it would be better for the aggrieved to aim lower, i.e. just limit the parties in a law suit to the locals, and then observe whether the WTBTS jumps in to defend their little brother stooges in Palookaville! I wouldn't hold my breath!

Room---I think we should ENCOURAGE people to sue the elders if they might be liable.
