SA...Im going to have a sit down with him within the week and tell him exactly what my intentions are. If he doesnt agree that they need to leave and that he is going to tell them forthwith, I am going to inform him that I will be seeking a lawyer in the matter to have them removed. And Im not waiting until December to begin the process. No check that...Im probably going to get a lawyer anyway because I dont trust him to tell them and I dont trust that he wont co-conspire with them to turn this around on me and call it an illegal eviction so...lawyer it is.

I applaud you standing up to them. NOBODY has the right to call someone and unload verbal judgement on them because they believe THEY have some spiritual power over that individual..particularly since they are male talking to a female. Fuck that.
There was a guy in our book study in MY HOUSE no less whose wife was dying of heart problems. I studied with the wife up until she got baptised. She died shortly thereafter. A year later my children and I were making cards for this brother on the anniversary of his wifes death thinking he was sad...and a sister said "Dont! Hes not grieving her! He got married less than a month after she died to a worldly woman he worked with!" NOBODY KNEW THIS IN THE CONGREGATION EXCEPT THE ELDERS AND THEIR WIVES! And this asswipe was sitting in MY house doing this "Wait on Jehovah for all thing" act while making a fool out of all of us. He obviously was having an affair with this woman if he was married to her under a month later and then DECIEVED all of us. And on top of that marrying a worldly woman when he was so fucking HOLY?? AND he was a ministerial servant!
I called him up and reemed him out for his hypocrisy and for cheating and for deceiving us to our faces. His reply was that he "had to marry her or he would have committed fornication and didnt want to stumble anybody by telling them." But that she was "studying and hoped to come to the hall some day." I told him that it was hypocrites like him who were driving me right out the door.

Ah...the person has to have been on the property using it and paying taxes on it for a VERY long time neither of which is applicable here for adverse possession.

Steal - quiet title??..thats rediculous. Does my roofer have title because he put the roof on? Or the guy who ran the crane who helped us put the walls up on the second floor? Thats just crazy. They were in there AGAINST my will and as the owner of record if I didnt co-agree to anything they did to the house then what claim except for maybe reimbursement could they possibly have? I will go look at the web site you gave me.

Thank you ALL soooo much for the information! AG all that work! You are very sweet. Gosh Id say you were "qualified" to make recommendations from a "non lawyer spokesperson" POV on this. :D I am going to have a sit down with my quasi-ex and just tell it like it is with him and ask to see what it is he has "in writing" which I think is more of a financial agreement of some kind than a lease and it was drafted by the two MEN in this case so how much water will that puppy hold? Because the "guests" he invited in helped him put down the flooring and put in the bathroom fixtures and finish painting, he had some kind of "help in exchange for rent" thing going on with them. I think he said he "owes" them like $10,000 for money they added to the finishing of the house to make it occupiable for themselves. But since they have been there over a year, that amounts to what...like $800 a month?? When their own mortgage was well over $2000 before? I agree now that you put it that way, that I may have the problem with my husband saying that he invited them, and that they are his guests, but if said guests have everything they own WITH them, including literally their kitchen sink, and no longer have an address of their own, and have painted the walls of the "guest rooms" to match their own bed spreads, I think maybe it has surpassed "guests" somewhere along the way :D.
I have a lease where I live now until the end of March 2011 and so will be here til then. By that time they will have been in my house 2 years. I told ex I would be giving notice to my landlord December 1, 2010 that I would not be renewing the lease for the April 1, 2011 period and that he will have to tell them, or I would, by that date that they have to leave. It appears that I will have to put all that in careful written terms to assure it doesnt become some "illegal eviction" problem because I know they are NOT gonna like this. But just because someone helped make improvements on a place does not entitled them to some kind of ownership, except if they had an agreement to be paid either in time or money, in which case they could foreseeably place a lien on the property or something. (I put a new towel rack in here and planted some flowers but that didnt buy me part ownership of it. )
Im glad I asked you guys...its definitely given me a clearer perspective of what i am up against here.

We own the property equally and mutually, bought during the marriage. Florida has 50/50 marital property laws. There is no lease. He has some "written" agreement between them so he says..havent seen this....but its substantially an illegal document with regards to them being lessees since husb cant do that without my signature. We are not eligible to refinance the house until two years from the date of the bankruptcy filing which is this Dec. He keeps checking his credit scores but wont tell me what he thinks he is going to do.

Well not even a week after I said I was moving, he was having secret meetings with his JW sister, her husband and their five children during which they all agreed to abandon THEIR house and move into MINE. (He said he "needed a roommate to help with the expenses" never mentioning there would be SEVEN of them) We had just added a second story and a four car garage to the house and it was still under construction from stem to stirn when I left which was also part of my needing to leave...we were living out of boxes and every wall was ripped open or under construction. The house is 4000 sf now. It was horrible living there and he was using the kids as slave labor. We ended up filing bankruptcy but keeping only the house when the housing market crashed. Its the only thing I have left.
So a month after I leave....that whole clan and all their crap moved into every corner of my house. (They have so much shit that even after a YEAR they have not moved all of it over there yet...storage lockers, sheds, garage...and every single appliance in their place came to my house) To the point now a year later that my husband (since we arent divorced yet) is considering "moving out and getting his own place" because he is overwhelmed with the crowded house, noise, clutter!! He said he "didnt know how to get out of this mess" WTF?? ... I dont feel sorry for him. But dammit...he ISNT GOING TO GIVE MY HOUSE TO THESE PEOPLE!! They DONT pay bills. They have filed bankruptcy twice in 9 years and arent paying back the money they got from my father in law nor are they paying their rent to my husband...who just lets it go and lets it go. But they have a new wide screen TV, and a new car for their unworking pioneer 19 year old son and all the latest cell phones and video games.
Meanwhile my two kids and I are living in a 1300 square foot townhouse and are on top of each other. Its nice...but insanely squished and between my rent and support from my husband it costs about 2800 a month for us to be here and for him to be THERE. Which is rapidly becoming unsustainable.
Well after a year of talking and calming down we have agree the marriage is a bust but that we can be civil to each other. I have proposed that we share the house. I live upstairs he lives downstairs as a way to solve this "mess". There are three bedrooms two baths a laundry and living room upstairs, three bedrooms a kitchen, dining, two baths and living room downstairs...all this is on a 3/4 acre lot mind you. Its quite beautiful there albeit unfinished. He has not said one word about my proposal. I am assuming he doesnt want the consequences of having to tell these people they now have to move all this shit OUT after moving it all IN. But nobody gave any consideration to my owning the damn place. They just did whatever the fuck they wanted and never asked me about any of it because Im the apostate and am given zero consideration.
So these people moved in and "helped" get the place livable...for themselves to live there. They abandoned their own house which is going into foreclosure. They have decorated, painted and furnished my entire house as if they are going to live there forever, including moving into my yard all his work trucks, trailers and extra cars...it looks like a redneck dump now. Makes me sick to see it. AND...the kicker is they have told my ex to tell me I am no longer allowed there! My own fucking HOUSE!
So I want it back. I want to MOVE BACK INTO MY HOUSE AND KICK THEM OUT! They have no formal lease and it turns out under the law he cant rent it to anyone without my permission. Nor can he refinance it nor can he sell it without me.
How do I get them out of there??? How much notice do I need and do I need an attorney to evict them?

Just a short observation on my Bible study.

beliefs, also to be honest i thought it would make a family member happy.
so i slowly and methodically refuted and questioned all the nutty things that my study teacher, or whatever he's called, tried to throw at me over a period of about 4 months.
