Whether his intent or not, JD is playing devil's advocate as a good law student should. It is all about what if and what would the jury decide and how to sway the thinking one way or another. It is NOT about what is right, reasonable or just. It is about representing a client who may be on one side or the other of an issue - that they want to win. Lawyers don't take sides or have an opinion unless they are paid.
True, but think about this. Isn't this a sadder commentary on the legal justice system in the US than any nonsense the rank and file can spew?
