okay, so my girls all moved out and we had three empty rooms and a lot of bills to pay.

Thanks PEC. I read that also. But what I need to know right now is how to get rid of the dog? Do I evict the dog???? I mean how can I legally make her either get rid of the dog or move out? When I told her earlier to get rid of it she said she would have to find somewhere else then. I said fine. Put it in writing. Then she changed her mind and is saying she wants to try to train the dog. I know this means FAILURE. She's not here enough to train the dog.

She paid up what she owes so now I can't evict her on the basis of not paying rent. So I'm stuck right now. But I cannot take another day with this dog peeing and pooping on my patio. It will be ruined.

The rocks are clean and nice. They form a beautiful trail. My son loves to play there with the rocks and his tonka truck. Now they are contaminated. I want to end this before they become more contaminated. They were expensive!!!

The concrete is already stained and smelly. I just don't even want to see that dog here another single day!!! She put it in the fence ... I think ... but it's out of the fence right now. Did it get itself out or did she not even bother doing what she was supposed to do. I would be able to live with it if it was in a fenced area in the corner of my yard that I rarely visit. But not right out my slider!!!

Thanks to EVERYONE. This is a very trying thing I'm going through. Nothing happened as planned.

First of all, she showed up with the $300 she owes me. So now I have full rent and deposit. The lady from church was very nice and I know her. I made us all sit down in the patio and it stunk like pee but the renter cleaned up the dog poop -- of course -- before she got there.

The renter said she doesn't want to move out. I told her that I changed the pet policy to no pets because her dog is not trained. She signed and initialled the entire lease but I put a lot of time and was very SPECIFIC thank God about the pet policy.

She asked me to give the dog a chance because he could not be trained in "one day". I reminded her that she had stated it was already trained when she brought him. She said she would put a fence in the corner of the yard and keep the dog there while she is not home. I told her,

"The only way to train this dog is to get up with it every TWO hours and take it to the spot where you want it to go. You ARE NOT GOING TO DO THAT. And even then it may not work."

What I need to know is whether I can change the pet policy right now to no pets????? She said she is not giving me notice to move out. Someone must have advised her. So here she is, rent paid in full with a piece of shit dog that goes wherever it wants!!!

If she got rid of the dog and paid on time, she would actually not be a bad room renter. She's never here. Which is why I don't know why she needs the dog.

She doesn't have her own entrance and walks through our foyer, living room and up the stairs down the hallway to her room. So she is definitely not a "tenant" but rather a "lodger". So from what Shelby posted it looks like I have more rights than if she were a tenant.

To make matters worse, my husband is not on my side. He hates the poop and pee too but he is worried about the mortgage since last night a bunch of people got laid off and he could be laid off too.

So he's right in a way ... as long as she pays or we are doomed. We would not be able to rent the room to anyone else while she could technically live there rent free. That's why I want to get her out and put the room up for rent again, this time with a no pet policy and get someone else.

This is a no win situation.

JO, when the lady sees the pee and poop on the patio and I make them sit right there and the flies start to pester. Trust me. There is no WAY she would not agree with me that the dog has to GO!

Also, I will make her sign that she is giving me notice she is moving out and I will make it be by the 17th. And I am going to make her give me the $300 she owes me too.

She can't sue me then if she gives me the notice. And I can keep her deposit because she didn't give me 30 days. I'm going to treat the patio and stain it. That should about cover the costs.

I'm a nice person. But don't freaking PISS ME OFF!

Oh great! Now she wants to meet with me with a lady from church present. Whatever! Bring it on! She said she doesn't want to meet at the house though. So I told her, "Why not? We can meet on the patio!" LOL

They are both on their way. Good. Now I will have a witness.

So it worked. She texted back:

"I guess I will have to find another place to live. I'm sorry this isn't working out. :("

I texted back:

"It's ok. U still owe me for the $100 garage rental and the deposit today. I will return it when you move out if you leave everything as you found it. I'm really sorry but you did tell me the dog was trained and I was very specific when you signed the lease. You knew up front that the dog needed to be fully trained."

No response.

So she just texted me back and said, "I'll be home in an hour. I'm cashing my check. (how could she do that without a license?????). Why? What's up?

So I want this in writing to show how much I tried. I texted back this:

"Well, the dog pooped and peed again. This time on the blanket too. I know this is going to be impossible. It's not culture shock. No one I know, not even animals, want to be where the feces goes. I'm really upset right now because I thought I was clear yesterday."

I said the "culture shock" statement because I forgot to tell you that yesterday she made a comment that it must be culture shock to us because we are not used to dogs. BULLSHIT! Yeah, It's culture shock because we don't want to sit and eat our meals or have a glass of wine on our patio/garden and be surrounded by shit and pee and flies! What a load of crap!!! It's culture shock to a dirty scumbag but not to regular people or even animals.

She juste texted back:

"I took him for a walk this morning like u asked and he peed then. It will take time for him to learn where to pee and poop."

I responded:

"He's not going to learn. He's never been trained and you said he was trained. He's peed and pooped there for weeks now so he will continue to smell it and go there no matter what you do. And even if you kennel him and take him out every couple of hours, which we know you will not do, he would still smell it there and continue to go there."

She texted back just now:

"What would you like me to do then?"

I said:

"I'm sorry and I understand if you need to move somewhere where the owner will not care. But the dog can't stay."

I hope this makes it easier for me and she gets the fletch out with no problem. Either way I will tell her to get rid of the dog by tomorrow. Then she might ask someone to watch him while she finds another place.....

OMG!!!! Everyone who called her a douche bag loser, etc. and called me STUPID.... YOU ARE ALL RIGHT!!!

So she was expecting TWO SSI checks, right? One from last month that supposedly never came and then the one from October which is due now. So yesterday one check comes. So I texted her and told her the check was here.

So she comes home, gets the check and leaves. I thought, "Hmmm she must be going to cash the check."

This was at around 2:00 PM. By 9:30 PM I was still waiting for her to come back. She strolls in the door and I looked at her like, "Where's my money?" She walks over and said, "You know what. I lost my drivers license and can't cash the check." WTF!!!!

So, I knew it was a lie and I said, "Wait a minute. You lost ONLY your drivers license? You have all your cards, your wallet, your purse...?"

She said, "Yeah, isn't that weird?"

I said, "Yeah. I want the money by tomorrow." My mom was right there.

This morning she got up way before me. She threw her piece of shit dog out on the patio --- didn't walk it, and left. Has not been home since.

So I go outside to find the dog shit all over again and peed all over again too.

So I just texted her and told her to come home so we can talk. I'm giving her 3 days to move out for non payment of rent and I'm giving her 24 hours to get the dog out of my house.

I'm DONE!

Clarification: I didn't handle this through text. I asked her to meet with me face to face and we did. I only texted her when she wasn't here because I wanted her to come home and pick up the dog shit. I like the texts so in case I need proof in the future.

I love the idea about when I go to evict her to tell her that I will pursue her for every dollar she owes but if she leaves in a week I will let it slide. That just might work. OTOH, she may already have bad credit so what would she care if I dinged it too?

I predict she is going to pay by Monday but flake out on the 17th. And no WAY is she going to get out and walk that dog. So it will be kicked out in a week. I will tell her to get rid of the dog or move out. I guarantee she is not going to walk the dog. She can't even get herself out of bed unless she has a bible study.

I will have no problem seeing her at church either. If she feels uncomfortable she can go elsewhere. I used to know this witness couple who bounced from house to house and trailer to trailer in congregation after congregation leaving a trail of disgruntled landlords along the way. The ones who DO the damage are usually the ones who leave.

It's a month to month lease. I learned my lesson all right. Next time don't get references from acquaintances who will sing the tenant's praises. Get a reference from the current landlord! And NO PETS. I can't stand pets of any sort. I hate the way a house smells when there is a pet and I don't like being licked .... It's NOT ME. I only like wild animals on TV lol. Once when I was five my dad took me to the zoo and I'll never forget the smell of it. I wanted to get the heck out of there!

I know my good judgement is jeopardized. I know everyone who is telling me to kick her out now is right. She does deserve it.

BUT, really I am waiting only 3 days. If she doens't pay everything she owes by Monday, the 4th, I will tell her she is out. Then I only have to live 30 days with her not paying before I can change the locks legally. So it's a risk but one that hope I can handle. I want to see her do it. She has a lot of problems and is on SSI. She's one of those people who say a lot, "I put it in the Lord's hands." So she is learning a lesson if she thought the Lord gave her a free place to live without doing anything for herself.

It's a good lesson learned for me and for her. I'm not typically a trusting person but I trusted her. So now I KNOW I am better off being a skeptic.

In addition, it makes me really miss my kids. They were a pain in the butt sometimes. And my husband was still laid off so we told them we either needed to rent the room out or for them to pay rent. They were like, "Mom, we wanna try it on our own. And you will get more money if we move out." (I was only going to charge them $150 each)

Well, we all learned our lesson there too. Because they are homesick. They are troopers and are toughing it out but they realize how great they had it here with us. It's good for them to struggle financially for a while. It builds character.

I'll keep everyone posted. I'm sure if we took bets it would all be one sided as the odds appear to be that she will continue to be a flake. On Monday I'll tell everyone if she paid. Then on the 17th I'll tell you if I had to give her the eviction notice.
