I can tell you what they are going to say ... what my GF's mom said to me when I initially spoke of the Napa cases ... how long ago did these things happen. JWs have now changed their policy. No one knew how to deal w/ the problem, so how can you hold the elders or the WTBTS to a higher standard. However, now the elders are told to call the cops (and she gave me an example of a kid I knew who was charged w/ molesting his step kids ... supposedly the wife went to the elders and the elders immediately called the cops in to investigate. guess what, the dude has not been df'd because he has not admitted to it. so does that mean later when he gets out and goes back to the religion that he can still become an MS and then elder?)

The Beauty of Dogs
by restrangled ini was always a cat lover, but after adopting my 2 big dobies, i am in awe.. there is a west wind coming in tonight after a miserably hot day.. my 2 boyz in the dark have their noses to that wind.
they announced my son coming home before he arrived.
he came out and greeted them and returned back inside the house.

I love dogs, grew up w/ them. However, I love big dogs because I grew up w/ ankle biters who were very yappy! I am not home enough for a dog and live in the concrete jungle, so I have 2 cats instead. I never thought I would have one cat, so to have 2 has been a big shock to a lot of people. But I LOVE them totally. The crazies that they are. At the end of the day when they snuggle up in bed w/ me and the purr and lay up against me. That puts a different spin to my crazy busy, argumentative, spin out of control life. They are my babies and I would have it no other way.

Thank you PEC for posting that warning. I was going to say something as well. There is currently an investigation under way in Chicago involving a few scams and unsuspecting people missing money.
2 things - 1 ... I get canker sores when I am stressed and/or very tired. I have been told that this is common because your body's immune system is at its lowest/weakest and thus any hidden virus will rear its ugly head. Herpes is very common. As was pointed out chicken pox is a form of herpes. Once you have it, it is in your system for good.
2 - my cat has herpes and I give him lysine (sp?) every day. The vitamin supplement is also helpful in humans.

Affidavit for a court custody battle with a JW mom/Non JW dad
by Billzfan23 inwhat kind of things would you put in an affidavit to the court for a custody hearing - list them out in this thread for me so that i can disperse each point across multiple pages, making a strong case.
i will start:.
blood transfusions: - jw children are refused blood transfusions that could save their lives.. how about school sports, flag salute, military service, discouraging college education, keeping "seperate from the world", armageddon teachings, etc.. help we fill in a little wordy description and elaborate on each point in this post - it would be very much appreciated!.

but the legal standard with child custody is best interest of the child
Thus, the need for a child rep. An impartial party to evaluate the kids and make a determination that is the best interest of the kids.

Thanks Seek - I probably should have read the whole thing before posting. Thanks for straightening me out. L_G
Edited to add:
I hope I get it before the WBTS tries to put a restraining order on sales.
They would have already had to have done this. Clearly based on the fact that e-watchman knows about it, the WTBTS knows about it. They would have already had their henchmen out breaking knee caps as soon as they got a whiff of it. So they are SOL. Too bad for them.

Very interesting indeed!
I would just like to add a couple of comments on a few things that have been stated in the prior posts:
I understand that this happens all the time in our often less than effective court system, that documents that are supposed to be sealed, aren't. It's just that so seldom does anyone ask for copies it really doesn't make any difference.
Actually, it is not very common. This is a huge snaffu! In most counties and cases, the documents are placed under seal w/ a protective order stating at the close of the case the party providing such responsive documents is responsible for removing them from the court's files. In other words, the documents are considered sealed until the end of the case and then those who want the docs to remain confidential are responsible for seeking leave to remove them.
Most court's do not want 5,000 pages of documents because of the cost to store such things. Further, in most counties discovery is not filed with the court unless there is a dispute and there is an in camera inspection. My guess is that this is what happened here.
Most settlements are deemed confidential and are not often times filed with the court or if they are they are sealed and remain under seal for eternity.
Most local rules have a section regarding sealed documents because of the foregoing reasons. The local rules dictate how they are to be handled.
Of the very few but very public cases where sealed documents were released, the clerks have always been the fall guys and have been fired and the counties have been sued and monies awarded. I have never heard of the person obtaining the sealed documents (who has done so in good faith believing they were no longer under seal and in turn the clerk pulling said documents and copying them) being sued or paying a fine. In the end, if the documents still fell under the seal, the opposing party would go in on a Motion for Temporary Restraining Order and Preliminary Injunction to prevent the documents from getting out. From what I can tell, this has not happened.
The statement that it is uncommon to seek prior discovery from older cases is not quite accurate only because of what was mentioned previously, most responsive discovery is NOT filed with the court. The court does not want all the paperwork that is often produced pursuant to discovery requests. Even in federal court, you will rarely see responsive documentation to requests for documents.
Ok - if you have read all that, good for you. I would not blame you if you skipped it! Here is my question ... you know how all JWs do the whole "jah's will" statement. Well ... should they try to say the documents were obtained thru shady means, how do they know that it was not in fact "jah's will" for the documents to get out to the public so as to protect all the future KH kids? How presumptuous of them to think otherwise. Maybe it was jah's holy spirit moving the WTBTS to forget to remove the docs or alternatively the clerk to assemble all FIVE THOUSAND pages, copy them and forward them to a third party who in turn released them to the public.
Good for Barbara. Maybe we can get extra copies of the October Awake about protecting your kids and place various smoking gun pieces from the Napa case and leave them around for the JWs to see. But sadly, I think we already know most of our families' responses, that it is just more persecution as was prophesied. They will turn a blind eye to the whole thing. They will continue to condemn the Catholic religion but act innocent to their own religion's crimes.

Based on the few divorce cases we have worked on, the court's will NOT decided on how a child is to be reared religion wise. The court's do not feel that it is their job and often judges are frightened that any such ruling will be appealed and over turned. Judges hate things going to the appellate court and being over turned. That being said, I don't think it is wrong to bring up religion. It is a common subject brought up in divorce actions. There are many families that are a blend of religions and when the parents divorce then it becomes an issue. However, it is the my way of the highway approach that the court's do not like. Because essentially how are YOU any different from your wife, by saying that you way is better, considering she feels her way is better. You need to stay objective as much as possible.
Most likely what will happen is that the judge will say that your wife is allowed to teach your kids the way she wants in her house and you are likewise allowed to do the same. We (as ex-JWs) know that this is very hard because of the black and white approach to their beliefs.
In Cook County the kids are automatically appointed a Guardian ad Litem. The Guardian is suppose to have the kids interest at heart. Also, there is an evaluation that is done (I cannot think of the name of it right now) where the kids meet w/ a shrink that evaluates the kids and makes suggestions to the court based on those meetings. You may want to seek that as well. This may establish if your kids are suffering w/ any anxiety associated w/ being in a JW house and a house w/ an ex-JW.
Billz - your kids are in the worst spot of all. I hope the best for you all. Just keep in mind, your kids did not sign up for this fight but are the little victims that will suffer the most (as w/ must divorces involving kids). Good luck to you. Think about family counseling w/ the kids to help the transition process.

I don't know if this is true or not, but what I recall from our yearly meccas to Bethel to visit family friends, we were told that the graves were intentionally not marked because they did not want anyone to use them as a shrine to the deceased. And then (again if I remember correctly) the example was given of Moses, Noah, I cannot exactly remember but it was a "prophet of old" and how they were buried in a quiet place so people could not use the site as a place of worship or them/their tombstone as an object of worship.
This may be total folklore in the JW faith, so I cannot confirm or deny the truth of what I was told.

From my personal experience the WTBTS own publications are sufficient enough for a judge to see how restrict the religion is. I am assuming you are doing an affidavit because you want custody of the kids? If so, have your attorney do a motion, then have a memorandum in support and in the memo you will reference specific things whether from a Watchtower, Awake or any other publication that would support your contention that the religion is restrictive and could be mentally and emotionally harmful to your children. I don't believe an affidavit would be sufficient for what you are seeking to accomplish (but I am not 100% sure what you are needing the affidavit for).
If you atty asked you for an affidavit then counsel should be drafting it for you and you would get final say as to its content.
