This truly will be an interesting decision.
Will a privilege that is part of a court rule trump a statute reporting law.
Will this somewhat new common law duty to report stand up for issues that are fairly easy to report.
And of course Will the Court buy into the statute of limitation argument that the ladies were unaware that their mother went to the WTS for advice and it wasn't until many years later did they find out via the mother, that the elders were told of the problems.
As for the mother failing to report. Well yeah, that is true and if I know the JW leaders, she was threatened with disfellowshipping and loss of God if she spoke out - and that is very very serious to a JW. I would say Mr. Berry is also responible too. But if we agree with the argument at hand then the elders also failed to report and they are, according to civil law created by Judge Groff, partially responsible and if found to be negligent by a jury the WTS must be held accountable for their actions. It would be up to the court/jury to decide what degree of responsiblity lies with each defendant and award damages accordingly.
