Feeling about recent events

poppers~ Kendrick had admitted to sexually abusing his step-daughter while she slept. She awakened during it and so he went to the elders and confessed and was removed as a Ministerial Servant. So, the elders KNEW he had a history of admitted abuse. It was on record. All they did was remove him as a MS, nothing more. Also, a few years after he abused Candace, he went on to be charged with sexual assault of a minor under the age of 14 (for another child who actually reported him) and was convicted and is a registered sex offender...He is also presently an active member of another congregation in which no one knew his past except the elders (due to that lovely "letter of recommendation" they send along when you switch congregations).
So, two SEPARATE congregations covered up this asshole's history of sexually abusing children when it came to protecting the congregation.

"penitential communication": a "penitential communication" for purposes of the privilege is a communication made in confidence, in the presence of no third persons so far as the penitent is aware, to a member of the clergy who, incident to the tenets of his or her religious denomination, is authorized or accustomed to hear such communications and has a duty to keep such communications secret.

Quendi, I was thinking the same thing. The very NAME of the proceedings contains the word JUDICIAL. It's basically a hearing, not a confessional. The person might be confessing to some sin, but it's in the name of being judged by a "jury" of three men and being determined repentant or not. And with everything else involved in a judicial committee, right down to the "jury" deliberating, any court can see this is not a confessional situation.

Doe v. Watchtower, et al./Post-Trial Motions
by DNCall inaccording to the alameda county superior court register of actions, the society will be bringing post-trial motions in an effort to have the judgment against it reversed.
in the meantime, it applied to the court for a stay of enforcement of the judgment now in place.
this is for protection during the time the post-trial motions are argued.

Phizzy, what they may not realize (or even care to realize since they don't think they will get caught) is that their "Theocratic Warfare Strategy" is still perjury. Telling a half truth or twisting the truth in such a way to mislead the court is still perjury. They can try to convince themselves they are telling the truth, but they're not telling "The truth, the whole truth, and NOTHING BUT the truth". So hopefully the WT lawyers aren't stupid enough to try the Theocratic Warfare angle.

JakeM2012, I guess my point was that even if they were directly questioned on that particular thing, how many would give a straight answer if they were guilty? I mean, they've hidden it all that time...long enough to jump through all the hoops in order to even be mentioned for appointment. They wouldn't wanna screw that up with a confession. So the questioning itself isn't worth anything.

I honestly don't know. With the Conti case, I feel like there might be some possible vindication for some of us who left partially due to the abuse that we found out about. I know I myself brought this up to my dad about how the org covered it over numerous times and he simply would not believe me. He insisted that "All brothers who get privileges are questioned as to whether they have a history of abusing children". Um. You think they'd tell the truth?? Come on! But with such a landmark case and such a HUGE loss for the Watchtower, I think anything is possible.
There will always be those who hang on, even while the ship is sinking. The responses online from JW's have been sickening for the most part. But, remember too that there are always those who are in but mentally out...like many of us here were at one time. And there are those with doubts sitting on the fence. We might see more traffic here due to that.
The Watchtower as a whole will take a long time to sink, though.

According to what was mentioned by sir82, the confidentiality afforded between the penitent and the clergy should be null and void...since they've already breeched that confidentiality by making the phone call or filling out the form. Once they invite a third party who is NOT in the room to hear the confession at the time the penitent confesses, I would think they negate the right to use this law in their favor.
I seem to recall in some states that the clergy are mandated reporters of child abuse, though... No matter if there was a confession given between a clergy member and a congregation member, it's supposed to be reported to police.
ETA: I just did a quick web search and clergy are enumerated as mandated reporters of child abuse in the state of California. Penitent-clergy privilege is granted, but limited to pastoral communications.

I think it would be a good idea for those of us who have them coming by or in the neighborhood to have copies of the news articles to give them. If it's from the New York Times, for instance, it's not "apostate literature". But at least it can be proven that it isn't just some rumor made to make them look bad, but it is in fact a reality that their publishing company masking as a religion is about to be over $20 million dollars lighter.

Not only that, but as far as I can see they haven't copyrighted the name Sparlock itself. Perhaps because he appears in the video, it falls under the copyright, though... HOWEVER, with a few minor adjustments, we might be able to tweak him enough that he becomes our mascot and no one can take him away... Just a couple of changes would make it so that their copyright isn't "infringed".
Does anyone else feel like this is just the Watchtower telling us apostates "My dick is bigger than your dick"?

Considering it's an artist's rendering of the character, couldn't it be fair use?? A lot of people sell their own renditions of celebrities (ie. Marilyn Monroe, Michael Jackson, etc) without having to go through copyrights because it's THEIR vision of the person and their own artwork. This isn't the ACTUAL clip from the dumbass dub film, it's an artists rendition of the character...
