A formal discharge from an organization whether it be termination of employment or excommunication from an organization will always carry the overtone of damage to another's reputation: defamation of character. That's why employers often require a contract(s) to be signed upon employment.
Everyone who's one of JWs understands why people are Dfd and agrees with it or they wouldn't be there. There are some people that are removed from the congregation and then all of the sudden no longer understand. That's more of a personal problem, not a legal problem.

by minimus ini honestly think that if individual elders thought they personally might get sued, they would back off from talking to you or trying to hunt you down.
i know i always was nervous that i'd havv=e to hire a lawyer and pay $$$ out of my own pocket.. what do you think?
might that not discourage elders from violating your rights or harrassing you?

I've never been harassed by an elder or had a reason to sue. I was disfellowshipped as a teenager because my parents who were Jehovah's Witnesses knew about my activities. When they spoke to the elders I just told them to disfellowship me. I''ve long since been reinstated but I haven't been to the meetings in eight months and an elder has contacted me one time. It seems that people here are sociopathically looking for ways to hunt down and get at Jehovah's Witnesses, not visa-versa.

It has to be explained in detail, with reference back to the Old Testament and the "historical" examples of Joseph and his brothers, just how generations can overlap and yet we're still in the time of the end. And then they go to the trouble of comparing birth years of members of the GB, which on the surface should smack everyone in the head how wrong the previous explanation was, but instead it somehow reinforces that because one old fart was still alive when a younger old fart was born, then we're still in the time of the end?
As we've discussed many times on this board, the GB will not get rid of 1914 because then they'd have to get rid of 1918 when Jesus supposedly 'inspected them', chosed them as the F&DSC which of course gives them their power structure. 1914 on it's own would be fairly easy to change. They could simply admit that Jerusalem was destroyed in 587 BCE which means Jesus returned in 1934, not 1914. They could easily tie this into the fact that Hitler was elected as Chancellor of Germany in 1933 which put the world on the pathway to WWII. Witnesses would buy this 'new light' like they do most of their bullshit doctrines. However, there is nothing scripturally that they can hinge on to to promote the idea that Jesus chose them in 1937 or '38.
Instead of admitting that they've been wrong for decades about the generation of 1914, they have tried numerous ways to try and wiggle out of it, while retaining their authority. Time is no longer on their side though and in 4 years, it will be 100 years since they declared "the world has ended". I'm sure they tried a thousand different scenarios in the Boardroom to see what they could come up with. The fact that an 'overlapping generation' was the best they could do shows that they're running out of excuses fast and are waiting to see how this 'new light' is accepted by a very weary people."
After communicating with different people, the biggest obstacle to most of the proof/ evidence (science based) atheists or agnostics in other religions is they haven't observed or experienced any intervention from God in society or in their personal life so they're left with a lot of unanswered questions.

Exposure to this asylum made some minor impression on me and has at times distorted any potential for a normal response. I've many times asked people simple questions and they often can't answer without going ballistic. This is an indicator people have things buried in their mind they're incapable of addressing logically. I don't necessarily answer all your questions.

If a young child tells an elder he/she was raped it gets reported.
"If the accused denies the charge, the two elders may arrange for him and the victim to restate their position in each other’s presence, with elders also there. If a young child tells something like that to an elder they don't let that go. I damn sure wouldn't.
If you really think about it, when would a young child tell an elder he/she was raped? Take him back in the Kingdom Hall library and explain the matter, that Mom or Dad is raping me? A young child is generally coerced into silence by the abuser and they often don't understand what is going on. The first girl interviewed said she told the elders about abuse when she was 15 that took place when she was 13. She said it was a friend of the family. You would think at the age of 13 she would have told her parents. She said she told the elders in hopes they would take care of this person. What would you do if a 15 year old told you she was raped by someone you know when she was 13 so you could “take care of the person?”
I would say you need to contact the authorities. If the truth of the matter is, there's no other witnesses and the accused abuser denies... after two years, there's no physical evidence: it wouldn't hold up in a court of law.
It's adults and older teens that tell the elders things and that's where the two witness rule applies. The witness that told an elder can inform CPS because the elders can't legally apprehend the abuser.The second person said she was 12 when her friend's older brother molested her. She said her and her parents went to the elders. The elders are not the police. When it comes to illegal activity you take that to the police where DNA evidence or something substantial can be gathered to make a case. The elders can't do this.
