Please help Lola

    I have a laptop that I bought December of 2005, I paid a good amount of money to get a full warranty on it, it is supposed to cover ANYTHING that happens to it, including things like theft, if I lost the laptop they would replace it with a new one and so on. Over a month ago the thing would not turn on, I took it into the store and they took it to their service dept and gave an order report, all I have to do is wait for it to be fixed. So, I wait and I wait and then I wait some more, by now it's been FOUR weeks and no word from the company. Finally I just called them, the first three times that I called no one came to the phone, finally two days later I get someone on the line, they inform me that they spoke with Lola and that they told her that the warranty was no longer covering the laptop. I then inform them that *I* am Lola and that no one had ever called me, the rep then says "Sure they did, they called you at ...." umm no actually you could not have called me at that number and spoken to me because I changed my number months ago, finally he says "Oh well whether they spoke to you or not is not important, all you need to know is that we will not fix your computer".

    I spoke with the manager who gave me the same information, finally I just requested that they retun my laptop, I went in to pick it up last night and had to wait over an hour for them to find it and release it, by the time I got home it was 9:30 and I was just tired so I left it alone, this morning I brought the laptop with me to work and removed all the wrapping they had place on it only to find that it was full of roaches, and filthy and that it smells ( I kid you not, it smells like it's burnt).

    So what should I do? Sue? Contact the BBB? Suck it up and buy a new one?

    Unfortunately, those warranties are worded so that they can do whatever they want.

    I had trouble with my HP laptop, (it wouldn't turn on-ha!) and Best Buy shipped it all over the damn place. It was out of my hands for over a month before I got it back, and I couldn't say anything about it. The warranty doesn't really entitle you to anything.

    Sorry.

    I'd suggest buying a new one, technology changes quick anyhow, you'll prob. come out ahead.

    Yes, report them to BBB. So much for your warranty, have it checked out.

    If it is the company that I think it is (BB) call corporate, explain what happened, and then tell them you want to speak to the district manager for that stores district. If it is "that" company you raise holy hell until you get a new one or a repair. I heard the same story not too long ago.

    There is no way they should be able to do that...

    Did you explain to them what was wrong with it when you left it to be repaired? If this is the case do you have any documentation because there is no way you'd do this to your own property.

    I'd go down there and demand to speak to someone and dont take any rubbish from them. After you've tried speaking to them and dealing it face to face say your going to take further action (which i am sure many from here will be able to advise you on).

    Re-examine your warranty. Check for an expiration of the warranty. Reconfirm the words "free replacement" in in the warrantee. If all writing is in your favor, go back and bitch out load until they honour the warrantee.

    KW13, yes I explained what was wrong with it when I left it for repair.

    The warranty is supposed to cover anything that happens to this laptop for as long as I own it ( that's what the paper work says and what the sales person told me) and it is in addition to the warranty that Toshiba offers.

    So long then as your Warranty is valid then you should of got a repaired laptop by now not one in its current condition.

    I'd go back down there and demand a full replacement and if that fails as i mentioned take it further. There are people on here that will be able to advise you on that. You have documentation that proves by now you should of had a working laptop, free of charge and failing that you should of got it back in the condition you gave it them which wasn't what it is now - a fancy looking paving slab.

    1) Call the consumer protection division of the state attorney general's office and get the forms to file a complaint (should also be able to do this on line)

    2) Ditto Better business bureau.

    3) Ditto small claims court

    4) Call the store in question get the name of the store manager and district manager

    5) Call those two individuals and tell them that you are filling out 1,2 and 3 and that their names will be on all documents.

    Tip for number 5, be very calm and business like. If they say anything other than "come down here and get your new computer." politely tell them you will see them in court and end the call.
