    The retired Marine that took on the Home Owners association for the right to fly his American Flag won the case against them and earned the right to fly his flag. However...he was then sued by the Home Owners Association to be forced to pay their legal fees. STUPID...he's appealling. If he's forced to pay their fees he will lose his home.

    This is a group of vindictive knuckleheads...where's the ACLU in all this???Not protecting his right to free speech...that's for sure.

    If he won, why in the world would they think he was responsible for their legal fees? I thought you only had a right to claim this if YOU won.

    As an owner of a few houses that have been within HOA's, I think I have a pretty good idea of how they usually work. Of course, some may just be extremely irrational, but in most cases minor violations like these just get ignored. The only time I've ever seen a HOA make a big deal out of something is when you have broken many rules and you are known as a problem neighbor. There may be more to this case than meets the eye. Is his house an eyesore? Does he have unapproved/loud pets or a broken-down car on his lawn? This may not be the case, but I've never seen anything escalate to this level without a lot more issues than just displaying a flag. It sounds like this guy has a lot of enemies in the HOA.

    best we can figure...the HOA changed the rules about flying flags after he bought his house...they asked him to take down the flag pole and flag,,,which are unobtrusive...he refused...they took him to court...judge ordered him to take it down...he refused...was fined 100 a day for 87 days during his appeal. He won the appeal. Then the HOA sued him for legal fees.

    If that's true, then that's one crappy HOA! I have a love/hate relationship with HOA's.

    One thing about HOA's is that there isn't usually someone driving around inspecting the properties. Usually a neighbor has to complain about you. It almost sounds like they are trying to kick this guy out of the neighborhood or something, or maybe his neighbors just don't get along with him.

    Someone got me started on homeowners associations. Two years ago we bought a home in a nice neighborhood with a liberal homeowners association. Not many problems, but no one ever went to the meetings (held them during the day at work) and and then they elected some old fart who went driving around the neighborhood spotting problems. Colors of mailboxes, leaving your trash cans out passed a certain hour on trash day. This woman, whom I'll call "Punitive Peggy", made some peoples lives miserable. Then 911 happened and everyone started flying their flags. PP had fits (they flap, she even had the nerve to say it messed with the neighborhood's feng shui.) Then I found out PP was a JW or claimed to be a JW. She told me one day she had "issues" with our flagpole. I told her she had more issues than a stack of Old Awakes!
