We have an HOA here, and it is a pain in the behind. In theory, a good idea, but they often get out of control, especially if someone with no life of their own finds their way into that position of power.

Thanks Dakota - I only knew what I knew through the Rush Limbaugh show & from what I read - hadn't heard any interviews. Thanks for clearing that up for me.
But, for anyone - why is this a "free speech" issue? And, would any of you have been commenting on this thread had the flag he had flying been a German, Iraqi or French flag?

For me, pg, it's "free speech" because that is what was used to pass constitutional protection of burning and desecrating the flag in protest. If it is free speech to protest and destroy the flag, why isn't it also free speech to respectfully display it? No community can pass any ordinances against destroying the flag, but they can pass ordinances against flying it? To me, that just isn't right.
As to other flags being flown, yes, I would stand for their right to display theirs too. Other flags don't bother me and really don't concern me that much, but this issue is about flying the American Flag within America, not anywhere else.
For a veteran to be punished for flying our National Flag within our borders is just assinine. If flying it in another country were the problem, then I'd say take it down, but this isn't another country.

But, and believe me, I'm only asking cuz I'd really like to understand - from what I understand, he could fly the American flag, as long as it was from brackets attached to his home. Now, I understand the bushes would have touched it if he were to place it in the "usual" place on the front of the home, but could he have not either #1 - lowered the bushes or #2 - raised the brackets? I really would like to understand why he couldn't just follow the rules like everyone else.

P.S. - for the record I think its unconsciousable that they would actually try to take away this guys home for this stupidity as well.

Would not the HOA be attempting to supersede the Constitution? You know for a contract to be legal it can not violat existing law. It makes me wonder how 'legal' HOAs are.
as americans we have some rights. However, anyone can have a private club, etc and establish their own rules. the theory is u do not have to belong to it..Like the WTS, they violate our rights all the time, but u know they say we can leave.
same thing with discussion boards, they are sort of a private club. U are atthe mercy of the owner.

Well, I can't really answer the why's of it all, that is a personal thing between them. But, bear in mind, the "rule" only became a rule after it was up and flying. Maybe he felt that since it was already existing, their rule didn't matter, or maybe, he just is proud to display the flag properly. Only he can answer that.
But, not to change the subject, I read here time and time again that dissension is a good thing and necessary for the betterment of everyone. Is this not also him dissenting against what may be an out of control HOA? Just a thought.

I don't see why this is even a question. Some peope agree and some don't agree with spending their money this way. Maybe these people don't live on the same street as this guy. Who knows?
Your point of view seems to be that it's got to be the former Marine who's an a%%hole...it couldn't be the HOA...right...Damned patriots flying their damned flags.
