where's the ACLU in all this???
Instead of conservatives bitching so much, why don't they start their own foundation similar to the ACLU that promotes conservative ideas and such?

There's a few facts that are conveniently left out of your slant on things here Yeru.
#1 - It was NOT about "hanging the American flag" as is being touted. It was about putting up a FLAG POLE in the middle of his lawn, which was directly against the agreement he signed when he joined the association & purchased a home in that community. He could have the American flag waving proudly, as long as it was hung from a pole connected to the house.
#2 - This man was totally pissed off at his homeowner's association for reasons that had nothing to do with this situation, and chose this as his "cause" because he thought it would garner him a little sympathy attention (which obviously he got).
Totally stupid that he even won the lawsuit.
SP: The ACLU is supposed to fight for anyones Constitutional rights, not just lefties. A person flying a flag is not necessarily "right". I like to see everyone flying the flag. Yet I'm pro choice. pro anybody can get married, pro open borders, anti-giveaways to non-citizens, pro legalization of drugs, pro-atheism so would the ACLU fight for my rights? Where do I fit in?

If the group is not properly representing conservatives, then maybe another group should be formed. It is primarily a liberal organization (I'm not saying that that makes it okay).
I was just about to jump into this from the "free speech" angle because I am a very strong supporter of free speech... I'm also patriotic. However, because of pettygrudger's clarification (don't ya love JW speak) I have to say that I'm quite disappointed in the way the matter was presented.
I have noticed that conservative Christians have a tendency to wave "discrimination" and "persecution" issues all over the place while omitting vital information that makes all the difference in the world as to what the true nature of the problem is.
This is a classic example. Yerusalyim made the deceptive claim... or at least strongly implied that this was a free-speech issue, when in fact it was a construction and zoning issue. Very deceptive and unethical in my opinion.
I heard about that one last week. Rush Limbaugh talked about it. He even had someone call in from the area who added a little to the story. The HA didn't totally prohibit flying the American flag, the guy could have had it on a flagpole attached to his house. There were also comments made that he was a "malcontent" and "troublemaker" so he should consider himself lucky he won the fight.
Rush made a good point on the issue. The man knew the rules of his HA when he bought the house and joined. He chose to violate the rule. There's a right and wrong way to do everything. I'm sure that some HA rules like this that aren't written in stone and could possibly be changed by meeting with the other homeowners and asking in the right way. At the very least, he could have followed procedure and asked for an exception to be made.
I've said this time and again, to both sides: "you gotta pick your battles".

Point in fact kiddies...this HOA agreement said absolutely NOTHING about a flag pole...the rule was changed AFTER he moved in..,it IS a free speech issue.
This is the offending beastie on it's 12 foot high flag pole:
He couldn't hand it from the brackets as the HOA demanded because the flag would have then touched bushes.
15 of his neighbors have filed suit against the HOA for wasting their money on this law suit.
Sean Hannity is currently advertising this cause on his radio program to raise the $25,000 needed to keep his home. Sean also said he would pay the entire $25,000 himself if it wasn't raised. He then went further and is offering to install flag poles and flags in any neighbors yard that wishes one, free of charge.
Maybe I'm just too radical, but it seems a sad state of affairs when burning and desecrating our national flag is consitutionally protected, but flying it high and proud isn't.
If displaying the flag is a type of free speech how could the HOA attempt to restrict it. Would not the HOA be attempting to supersede the Constitution? You know for a contract to be legal it can not violat existing law. It makes me wonder how 'legal' HOAs are.
Maybe the marine should have hung a NAMBLA banner under the flag so the ACLU would defend him.

Anyone can sign away their constitutional rights with a single stroke of a pen.
