After 10 years of employment, I was terminated today!

    Tomorrow I am going to collect my things. I feel horrible that it happened, really I do... I guess God allows things like this to happen to us to show the error of our ways. I had been neglecting me for a very long time now. I have gained a ton of weight these past few years and not cared about my appearance. I mean I used to be a size 10 and now I am double that. I have gained 80 lbs in the last 7 years...throwing it out there but also not blaming anyone but myself, and trying to have a healthy attitude. I feel badly for my immediate boss, I absolutely adore him and will miss his sweet but grouchy demeanor (he hates Bush). I hope to speak with him soon and tell him my true feelings. Perhaps a card will do the trick!

    so sorry to hear of this, cant you go sue for unfair dismissal? It just seems like that got rid of you coz they don't like you. Dont know if its the same over there but in Australia its very hard to fire anyone es

    It isn't easy to fire someone here in Missouri either. Usually they transfer them to a different department or give them a warning.

    Did you sign a confidential agreement? You wouldn't believe how easy a lawsuit would get your job back.

    I worked in a bank..you wouldn't believe the things that went on. Money missing..trics played by customers. I don't think I remember but one time someone getting fired.

    Stealing a step ladder that belonged to the bank!

    He said he just borrowed it and was going to bring it back. Another employee told on him. He was our branch manager!
    The day he left he brought it back with a BIG bow on it.

    He is now the Bank manager over several branches of another bank.

    Ironic huh?

    Is it worth filing a lawsuit? Do I have a case? No and No. Do I wish I could go back and redo everything? Of course. I love surfing the Internet, and I was bored at work so I did it anyway. I will never surf the Internet at work ever again. Probably could have gotten away with it if I had not accessed personal information, which I wasn't doing anything malicious and I explained that but it doesn't matter and they didn't want to hear it...

    It sounds like you were sick of the job and would have left sooner or later anyway. All they did was make the decision for you.

    I'm sure you will be better off in the long term.

    Enjoy some freedom for a while. It's summer. Go fishing.

    Sorry to hear about you're sacking. I think it's pretty underhand the way companies try and get you to sign resignation forms when they sack you. They're frightened of being taken to employment tribunals.

    I wouldn't worry too much about it, you're obviously intelligent and will get snapped up by another employer. I quit my job last month, you can join me on the old rock n roll and enjoy the sunshine.

    I work for an employment litigation firm in the UK so have experience of these things, If they have treated you inconsistently then you may well have a potential claim for Unfair Dismissal and Breach of Contract before your local Employment Tribunal; I think in NI they are called Fair Employment Tribunals but the law largely mirrors that of England & Wales anyway.

    If you need some informal advice PM me (I wont charge you )...you could have a claim if they didnt follow an appropriate procedure in dismissing you and especially so if they have treated you inconsistently; you have not told us why you have annoyed someone in the school but there could be a possible claim of victimisation should your reason for annoying this person be linked to certain protected acts, health & safety, or whistleblowing; asserting your statutory rights and many more.

    These things are usually settled anyway so wouldnt probably get to trial;

    Oh yes I forgot to mention whether you resigned or not there is binding case law to suggest that a resignation letter signed by yourself but signed after a disciplinary hearing is still classed as a dismissal by an Employment Tribunal; you really need to get some advice on this.

    The basic position here was well summarised by Sir John Brightman in East Sussex County Council v Walker (1972) 7 ITR 280, NIRC:

    ?Suppose that the employer says to the employee, ?Your job is finished. I will give you the opportunity to resign. If you don?t you will be sacked.? How, we would ask, is it possible to reach a conclusion other than that employment is being terminated by the employer, even though the employee takes the first and more respectable alternative of signing a letter of resignation rather than being the recipient of a letter of dismissal? We feel that in such circumstances there really can be no other conclusion than that the employer terminated the contract?.
