They are now protesting shunning in Italy !!!! ITALIAN EX-JWs PROTEST DISCRIMINATION IN ROME: Disfellowshipped Italians protested discrimination in Rome near the Chamber Of Deputies on December 1. Literature was handed out, legislators and media informed; an article will be appearing in a major Italian paper. Protestors came from all over Italy and some of Switzerland:

BRAZILIAN EX-JWs LAWSUIT HEADING TO NATIONAL SUPREME COURT; THREATS MADE: A lawsuit spearheaded by Sebastian Ramos of the Fortaleza area in northeastern Brazil is advancing again. Ramos and his supporters had held a protest rally with speech, marched with huge banners noting that Watchtower has “Jehovah’s Witnesses discriminate against former members,” put out leaflets etc; have support from human rights activitists etc.
Threats have been made against them. Their peaceful activities were photographed by opponents etc, some counter protesting made calling for the lawsuit against Watchtower to be dropped. Ramos has applied to enter a witness protection program for safety, but the cause that he made public is advancing again despite an early effort by Watchtower to block it.
Will their activism now spark similar efforts in the U.S. and other nations?

Since the meeting of CRDHDR in Fortaleza (CE), which occurred on December 15, 2009, in the auditorium Murilo Aguiar, of the Legislative Assembly of Ceará State, we have knowledge about, among other issues, the complaint lodged by Mr. Sebastian Ramos, as to discrimination faced by ex-Jehovah's Witnesses (JWs), at direction from their church, an imposition upon those disfellowshipped and disassociated from others into a "social isolation", ie, there is guidance by the religious organization, which is that all contact is to be avoided with people who may have been expelled or voluntarily left the church, even if they are also involving families and minors, this being based on their own interpretation, widely distributed among their members.It is worth remembering that this directive of the church, is also applied in all countries where it is present and in the case of Brazil, we understand that there are two issues to consider, where on the one hand there is the constitutional guarantee of freedom of belief and of thought, and on the other hand, also in the same constitutional text and infra-constitutional legislation, beyond declarations and agreements signed and approved by Brazil, there are also assurances that in fact of whether or not involving a belief or change of religion, one can not be subjected to any discriminatory act on behalf of such possible options.
Thus, in view of these facts, we can convene another court, but the main issue denounced by ex-Witnesses in Ceará, devolves without a doubt in such a clear and unequivocal manner is that they are being victimized by intolerable practices as they are alienated from a normal social life, especially as regards with family members, causing them hardship and emotional sequils that can not be measured, and they are motivated by the fact they are no longer in the religion but rather are communing with their own ideas and principles.
As we have witnessed throughout 2010 the events of this situation, we consider it necessary and reasonable, that all the actions that have been and are being worked upon by the group of ex-Witnesses in Fortaleza , should be enumerated:

- Charges filed with the Attorney General of the State of Ceará, with a robust presentation of evidence; - Presentation of the charges along with defense organizations of Human Rights (State Council for HR - HR Committee of the Legislative Assembly of the State Commission of HR of the City Council of Fortaleza, this CRDHDR, etc.);
- The completion of several public events of orderly manner and in accord with the law, such as were public acts, the placement of billboards and banners; interviews in various media (radio, newspapers, TVs and other media);
- Participation and public hearings, attended by federal authorities, among others, where the facts were reported, under the supervision of society and press bodies, including of the state;
- Dissemination to ex-Jehovah's Witnesses throughout the country and the international community as regards the progress of discussions with the Brazilian justice system, as well as regards repercussions, solidarity and even receiving the of criticism over the internet, as well as anonymous threats or intimidation.In view of all these mobilizations , we here reiterate our knowledge about some of the developments that have arisen, namely: - In the legal field:
1 - Acceptance and forwarding of the charges for the prosecution of Ceará; 2 - Establishment of the process underway in the 6th Criminal Court of the District of Fortaleza;
3 - After the manifestation of church officials then cited in the proceedings, it was held that the action was for the assessment of the 1st Criminal Chamber of the Court of Ceará (ECJ);
4th - On August 31, 2010, the 1st Criminal Chamber, ruled by locking the criminal action, in particular based upon a technical matter, manifested by the understanding that, who should have been represented in the lawsuit, would not be the Elders acting as church representatives in Ceara, but most certainly the national ecclesiastical community of the church, given the fact that the obstacles concerning "social and family" concerns are the result of an understanding and determination of the national assembly, thereby affecting all Ex-Jehovah's Witnesses in the country, and that it would avert any new lawsuits on the issue; 5 - The Office of Justice of Ceará, promoted on 26.10.2010, the bringing of a Special Appeal, which upon being admitted, is that the question will be considered by the Superior Court of Justice – the Supreme Court in Brasilia.- In the social sphere: 1 - The knowledge by society in general, of the existence of this situation, which was only known by members and former members of this religious segment;
2 - The recognition and solidarity of civil society and leaders of other religions, as well as representatives from various segments of the public sector, as to the seriousness of the facts presented;
3 - From these actions of Ex-Jehovah's Witnesses in Fortaleza, which is a landmark matter in that there has never before been discussion on this subject for exposure to society in general, held with national and international repercussions, where many people are in the same situation beginning to call at the same time to show whole group cohesion; 4 – Continuing, the impact of these events are being reported on and published by several Internet sites in Brazil and abroad, besides which there is the updating of information on the progress of this case in Brazil;
5 - The general awareness among various segments of society, the just motivation of a group of Ex-Jehovah's Witnesses, has caused or ignited the start of all these mobilizations and the pursuit of judicial remedies.- Contrary demonstrations: Mr. Sebastian Ramos, having assumed a leading position throughout the movement, especially in the judicial process and the dissemination of facts, has since then, in addition to support, also received and been subjected to contrary protests, as he himself has reported and as have been confirmed by the group of ex-Witnesses, as listed below: 1 - The reception of threats by members of the entire community then, and from persons via the internet;
2 – Accompanying public events promoted by ex-Witnesses, in particular peaceful demonstrations, there was a follow-up making of photographic record of the public activities, as well as of banners and billboards posted in various parts of the capital of Ceará which were made alluding to the case.
3 – Involvement of two constituents of the JWs in public demonstration on May 13, 2010 at Ferreira Square, downtown Fortaleza (Abolition of Slavery), promoted by the Forum Cearense of Religious Diversity; extending aggressive gestures for having the charges be stopped; 4 - People are saying Watchtower lawyers photographed banners placed in the homes of a friend of the cause, asking the owner intimidatively, where others were located;
5 – Additional estrangement from family and friends also members of the religious institution.Given these facts, Mr. Sebastian Ramos, in a preventive manner, ultimately seeks to be registered in the witness protection program of the Department of Human Rights - SDH, Federal Ministry. We point out that one of the main institutional and legal support that the group of ex-JWs has received, has been the Office of Frei Tito de Alencar, who is bound by the Human Rights Commission of the Legislative Assembly of the State of Ceará, which has been tracking this case. It is interesting for us to consider that this whole issue has become a unique feature in the field of motivation regarding religious intolerance, represented by virtue of the fact that it is not manifested by a religious member or segment of a religion in relation to religious expression, as is more common in our country, but most certainly, by a group with respect to its former members.
We recognize that all the actions undertaken by the group of ex-Jehovah's Witnesses are by no means directed against the Church of Jehovah's Witnesses, but specifically what might be considered or construed as religious discrimination, manifested through social isolation perpetrated against thousands of people in Brazil, that not withstanding religion, merely seeking to win justice, or observance of human rights,
it is indisputable that there is now little chance of his being returned to his family and friends , the life that existed previously, which fact in itself makes it clear that these ex-church members will be harmed forevermore as the previous mold is still set for those still within the religious body.
Finally, by way of information, let us remember that a matter has arisen from a court recently held in Sao Paulo, where the parents of a child and a doctor are to be brought before jury in accountability for the death of a minor, regarding their disallowing blood transfusion as involved in the JW church, not allowing this procedure on their own theological understanding, so that we see that in the future, the Brazilian justice system is expected to adopt a definitive position upon which of the rights guaranteed by our Constitution, in theory are the most important; bearing upon a case like this; the right to life; the (social) entrenchment clause, or the right to religious freedom? This is considering in the afore-cited situation, that religious belief was a determining factor by which life was not saved.

Reconhecimento e apoio ao movimento dos Ex-TJs do Ceará Publicada em: 29/11/2010 Desde a realização da reunião do CRDHDR em Fortaleza (CE), ocorrida em 15 de dezembro de 2009, no auditório Murilo Aguiar, da Assembléia Legislativa do Estado do Ceará, pudemos ter conhecimento acerca, entre outras questões, da denúncia então apresentada pelo senhor Sebastião Ramos, acerca da discriminação sofrida pelos ex-Testemunhas de Jeová (TJs), as quais face uma orientação da igreja, há uma imposição aos desassociados e aos dissociados, de um “isolamento social”, ou seja, há a orientação por parte da organização religiosa, que seja evitado todo e qualquer contato com as pessoas que porventura foram expulsas ou que voluntariamente saíram da igreja, mesmo que sejam familiares e atingindo inclusive menores de idade, isso com base em interpretação própria, amplamente divulgada junto aos seus membros. Vale lembrarmos que esta determinação da igreja, é também aplicada em todos os países onde a mesma está presente, e no caso do Brasil, entendemos que existem duas questões a serem consideradas, onde de um lado, há a garantia constitucional da liberdade de crença e de pensamento, e de outro; também no mesmo Texto Constitucional e na legislação infraconstitucional, além das Declarações e Acordos Internacionais subscritos e referendados pelo Brasil; existem as garantias de que o fato de se ter ou não uma crença, ou de mudar de religião, não pode ser objeto de qualquer ato discriminatório por conta destas eventuais opções. Assim sendo, diante dos fatos, não podemos formar outro juízo, senão o de que toda questão denunciada pelos ex-TJs do Estado do Ceará, se enquadra sem sombra de dúvidas, como sendo exemplo claro e inequívoco de que os mesmos estão sendo vitimados por práticas intolerantes, na medida que são alijados de um convívio social normal; principalmente com familiares; provocando-lhes sofrimentos e seqüelas emocionais que não podem ser mensuradas, e que são motivados pelo fato de apenas não estarem mais na religião, não comungando com suas idéias e princípios. Como temos acompanhado ao longo deste ano de 2010 os acontecimentos decorrentes desta situação, consideramos necessárias e cabíveis, todos as ações que foram e estão sendo trabalhados pelo grupo de ex-TJs na capital cearense, as quais enumeramos: Links do acompanhamento: http://www.dhdiversidadereligiosa.com.br/noticias/not023.htm http://www.dhdiversidadereligiosa.com.br/noticias/not076.htmhttp://www.dhdiversidadereligiosa.com.br/noticias/not090.htm - Denúncia dos fatos junto ao Ministério Público do Estado do Ceará, com robusta apresentação de provas; - Apresentação da denúncia junto aos organismos de defesa dos Direitos Humanos (Conselho Estadual de DHs – Comissão de DHs da Assembléia Legislativa do Estado, Comissão de DHs da Câmara de Vereadores de Fortaleza, este CRDHDR, etc); - A realização de diversas manifestações públicas ordeiras e na forma da lei, tais como , atos públicos; colocação de outdoors e de faixas; entrevistas em diversos meios de comunicação (rádios, jornais, tvs e outras mídias); - Participação e realização de audiências públicas, com a presença de autoridades da esfera federal, entre outras, onde os fatos foram relatados, sob o acompanhamento da sociedade e cobertura de órgãos de imprensa, inclusive estatais; - Divulgação junto a ex-TJs de todo o país e da comunidade internacional, do andamento da discussão junto à justiça brasileira, bem como , das repercussões, solidariedade e até o recebimento de críticas através da internet, bem como , ameaças ou intimidações anônimas. Face toda esta mobilização, reiteramos nosso conhecimento acerca de alguns desdobramentos decorrentes, a saber: - No âmbito jurídico: 1º - Aceitação e encaminhamento da denúncia por parte do Ministério Público do Ceará; 2º - Instauração do processo que tramitou na 6ª Vara Criminal da Comarca de Fortaleza ; 3º - Após manifestação dos representantes da igreja então citados no processo, decorreu que a ação foi para a apreciação da 1ª Câmara Criminal do Tribunal de Justiça do Ceará (TJCE); 4º - Em 31 de agosto de 2010, a 1ª Câmara Criminal, se pronunciou pelo trancamento da ação penal, em especial por uma questão técnica, manifestada pelo entendimento de que, quem deveria haver sido representado na ação, não seriam os Anciãos representantes da igreja no Ceará, mas sim, a comunidade eclesial da igreja nacionalmente, visto a constatação de que os óbices relativos ao “convívio social e familiar” decorrem de um entendimento e determinação da congregação nacional, atingindo portanto a todos os Ex-TJs no país, o que não inviabilizaria uma nova discussão judicial sobre a questão; 5º - A Procuradoria de Justiça do Ceará, promoveu no dia 26.10.2010, a interposição de Recurso Especial, que em sendo admitido, levará a questão a ser apreciada pelo Superior Tribunal de Justiça – STJ, em Brasília. - No âmbito social: 1º - O conhecimento por parte da sociedade em geral, da existência desta situação, a qual era somente sabida pelos membros e ex-membros deste segmento religioso; 2º - O reconhecimento e a solidariedade de organizações da sociedade e lideranças de outras religiões, bem como de representantes de diversos segmentos do setor público, da seriedade dos fatos apresentados; 3º - A partir destas ações dos Ex-TJs de Fortaleza, que se constituem num marco histórico, pois nunca antes havia este assunto sido exposto junto à sociedade em geral, decorreu uma repercussão nacional e internacional, onde diversas pessoas que se encontram na mesma situação passaram a exortar e ao mesmo tempo se solidarizar com todo o grupo; 4º - Ainda sobre a repercussão destes acontecimentos, em diversos sítios da internet no Brasil e no exterior, estão sendo publicados e reproduzidos artigos sobre a questão, além da atualização destas informações sobre o andamento do processo no Brasil; 5º - A consciência geral por parte de vários segmentos da sociedade, da justa motivação do grupo de Ex-TJs, que ensejou o início de toda esta mobilização e a busca dos meios judiciais. - Manifestações contrárias: Tendo o Sr. Sebastião Ramos, assumido uma posição de vanguarda em todo o movimento, em especial no andamento do processo judicial e na divulgação dos fatos, desde então, além dos apoios, também tem recebido e sido objeto de manifestações contrárias, relatadas pelo mesmo e confirmadas pelo grupo de ex-TJs, abaixo enumeradas: 1º - O recebimento de ameaças por membros de sua então comunidade, e por pessoas via internet; 2º - Acompanhamento nos eventos públicos promovidos pelos ex-TJs, em especial nas pacíficas manifestações, fazendo registro fotográfico dos atos públicos, bem como das faixas e dos outdoors postados em várias partes da capital cearense, que faziam alusão ao caso. 3º - Intervenção de dois integrantes das TJs em manifestação pública do dia 13 de maio de 2010 na Praça do Ferreira, centro de Fortaleza (Abolição da Escravatura), promovida pelo Fórum Cearense da Diversidade Religiosa; apoiador da causa; com gestos agressivos exigindo que a denúncia teria que parar; 4º - Pessoas se dizendo advogados da Torre de Vigia, fotografaram faixas colocadas em residências de amigo da causa, indagando ao proprietário de forma intimidatória, onde existiriam outras; 5º - Um afastamento ainda maior dos familiares e amigos ainda membros da instituição religiosa. Diante destes fatos, decorreu que o Sr. Sebastião, de forma preventiva, terminou por buscar ser cadastrado no programa de proteção de testemunhas da Secretaria de Direitos Humanos – SDH, ministério federal. Salientamos ainda que, um dos principais apoios institucionais e jurídicos que o grupo de ex-TJS tem recebido, vem ser do Escritório Frei Tito de Alencar, que é vinculado a Comissão de Direitos Humanos da Assembléia Legislativa do Estado do Ceará, o qual vem acompanhando o caso. É interessante consideramos que toda esta questão possui uma característica única, no campo da intolerância por motivação religiosa, representada pelo fato de se manifestar não de membro ou de um segmento religioso com relação à outra expressão religiosa, como é mais comum em nosso país, mas sim, de um grupo com relação a seus ex-membros. Reconhecemos que todas as ações desenvolvidas pelo grupo de ex-TJs, de forma alguma são direcionadas contra a Igreja Testemunhas de Jeová, mas sim, especificamente ao que pode ser considerado ou entendido como discriminação religiosa, manifestada através do isolamento social perpetrado contra milhares de pessoas no Brasil, que não participam mais da religião, de maneira que, mesmo tendo consciência que, meramente a busca do reconhecimento pela justiça, destas não observâncias aos direitos humanos, é indiscutível a pouca probabilidade de que haja o retorno junto aos seus familiares e amigos, da convivência antes existente, o que por si só, torna claro que para sempre estes ex-membros da igreja estarão prejudicados, pois o retorno das relações aos moldes de outrora é obstaculizado pela concepção difundida dentro do organismo religioso para aqueles que ainda nele estão integrados. Por fim, a titulo de informação, lembramos que a partir de uma questão advinda de uma decisão judicial ocorrida em São Paulo recentemente, onde os pais de uma criança e um médico, serão levados à júri popular, por responsabilização pelo falecimento da menor, face a não permissão de transfusão de sangue, por serem os envolvidos pertencentes a igreja TJ, e esta não admitir este procedimento por entendimento teológico próprio, vemos que num futuro, a justiça brasileira deverá se pronunciar de forma definitiva, sobre qual dos direitos garantidos pela nossa Constituição, será em tese o mais importante; diante de um caso como este; o direito à vida; cláusula pétrea; ou o direito à liberdade religiosa? Recognition and support for the movement of Ex-Jehovah's Witnesses in Ceará

Since the meeting of CRDHDR in Fortaleza (CE), which occurred on December 15, 2009, in the auditorium Murilo Aguiar, of the Legislative Assembly of Ceará State, we have knowledge about, among other issues, the complaint lodged by Mr. Sebastian Ramos, as to discrimination faced by ex-Jehovah's Witnesses (JWs), at direction from their church, an imposition upon those disfellowshipped and disassociated from others into a "social isolation", ie, there is guidance by the religious organization, which is that all contact is to be avoided with people who may have been expelled or voluntarily left the church, even if they are also involving families and minors, this being based on their own interpretation, widely distributed among their members.It is worth remembering that this directive of the church, is also applied in all countries where it is present and in the case of Brazil, we understand that there are two issues to consider, where on the one hand there is the constitutional guarantee of freedom of belief and of thought, and on the other hand, also in the same constitutional text and infra-constitutional legislation, beyond declarations and agreements signed and approved by Brazil, there are also assurances that in fact of whether or not involving a belief or change of religion, one can not be subjected to any discriminatory act on behalf of such possible options.
Thus, in view of these facts, we can convene another court, but the main issue denounced by ex-Witnesses in Ceará, devolves without a doubt in such a clear and unequivocal manner is that they are being victimized by intolerable practices as they are alienated from a normal social life, especially as regards with family members, causing them hardship and emotional sequils that can not be measured, and they are motivated by the fact they are no longer in the religion but rather are communing with their own ideas and principles.
As we have witnessed throughout 2010 the events of this situation, we consider it necessary and reasonable, that all the actions that have been and are being worked upon by the group of ex-Witnesses in Fortaleza , should be enumerated:

- Charges filed with the Attorney General of the State of Ceará, with a robust presentation of evidence; - Presentation of the charges along with defense organizations of Human Rights (State Council for HR - HR Committee of the Legislative Assembly of the State Commission of HR of the City Council of Fortaleza, this CRDHDR, etc.);
- The completion of several public events of orderly manner and in accord with the law, such as were public acts, the placement of billboards and banners; interviews in various media (radio, newspapers, TVs and other media);
- Participation and public hearings, attended by federal authorities, among others, where the facts were reported, under the supervision of society and press bodies, including of the state;
- Dissemination to ex-Jehovah's Witnesses throughout the country and the international community as regards the progress of discussions with the Brazilian justice system, as well as regards repercussions, solidarity and even receiving the of criticism over the internet, as well as anonymous threats or intimidation.In view of all these mobilizations , we here reiterate our knowledge about some of the developments that have arisen, namely: - In the legal field:
1 - Acceptance and forwarding of the charges for the prosecution of Ceará; 2 - Establishment of the process underway in the 6th Criminal Court of the District of Fortaleza;
3 - After the manifestation of church officials then cited in the proceedings, it was held that the action was for the assessment of the 1st Criminal Chamber of the Court of Ceará (ECJ);
4th - On August 31, 2010, the 1st Criminal Chamber, ruled by locking the criminal action, in particular based upon a technical matter, manifested by the understanding that, who should have been represented in the lawsuit, would not be the Elders acting as church representatives in Ceara, but most certainly the national ecclesiastical community of the church, given the fact that the obstacles concerning "social and family" concerns are the result of an understanding and determination of the national assembly, thereby affecting all Ex-Jehovah's Witnesses in the country, and that it would avert any new lawsuits on the issue; 5 - The Office of Justice of Ceará, promoted on 26.10.2010, the bringing of a Special Appeal, which upon being admitted, is that the question will be considered by the Superior Court of Justice – the Supreme Court in Brasilia.- In the social sphere: 1 - The knowledge by society in general, of the existence of this situation, which was only known by members and former members of this religious segment;
2 - The recognition and solidarity of civil society and leaders of other religions, as well as representatives from various segments of the public sector, as to the seriousness of the facts presented;
3 - From these actions of Ex-Jehovah's Witnesses in Fortaleza, which is a landmark matter in that there has never before been discussion on this subject for exposure to society in general, held with national and international repercussions, where many people are in the same situation beginning to call at the same time to show whole group cohesion; 4 – Continuing, the impact of these events are being reported on and published by several Internet sites in Brazil and abroad, besides which there is the updating of information on the progress of this case in Brazil;
5 - The general awareness among various segments of society, the just motivation of a group of Ex-Jehovah's Witnesses, has caused or ignited the start of all these mobilizations and the pursuit of judicial remedies.- Contrary demonstrations: Mr. Sebastian Ramos, having assumed a leading position throughout the movement, especially in the judicial process and the dissemination of facts, has since then, in addition to support, also received and been subjected to contrary protests, as he himself has reported and as have been confirmed by the group of ex-Witnesses, as listed below: 1 - The reception of threats by members of the entire community then, and from persons via the internet;
2 – Accompanying public events promoted by ex-Witnesses, in particular peaceful demonstrations, there was a follow-up making of photographic record of the public activities, as well as of banners and billboards posted in various parts of the capital of Ceará which were made alluding to the case.
3 – Involvement of two constituents of the JWs in public demonstration on May 13, 2010 at Ferreira Square, downtown Fortaleza (Abolition of Slavery), promoted by the Forum Cearense of Religious Diversity; extending aggressive gestures for having the charges be stopped; 4 - People are saying Watchtower lawyers photographed banners placed in the homes of a friend of the cause, asking the owner intimidatively, where others were located;
5 – Additional estrangement from family and friends also members of the religious institution.Given these facts, Mr. Sebastian Ramos, in a preventive manner, ultimately seeks to be registered in the witness protection program of the Department of Human Rights - SDH, Federal Ministry. We point out that one of the main institutional and legal support that the group of ex-JWs has received, has been the Office of Frei Tito de Alencar, who is bound by the Human Rights Commission of the Legislative Assembly of the State of Ceará, which has been tracking this case. It is interesting for us to consider that this whole issue has become a unique feature in the field of motivation regarding religious intolerance, represented by virtue of the fact that it is not manifested by a religious member or segment of a religion in relation to religious expression, as is more common in our country, but most certainly, by a group with respect to its former members.
We recognize that all the actions undertaken by the group of ex-Jehovah's Witnesses are by no means directed against the Church of Jehovah's Witnesses, but specifically what might be considered or construed as religious discrimination, manifested through social isolation perpetrated against thousands of people in Brazil, that not withstanding religion, merely seeking to win justice, or observance of human rights,
it is indisputable that there is now little chance of his being returned to his family and friends , the life that existed previously, which fact in itself makes it clear that these ex-church members will be harmed forevermore as the previous mold is still set for those still within the religious body.
Finally, by way of information, let us remember that a matter has arisen from a court recently held in Sao Paulo, where the parents of a child and a doctor are to be brought before jury in accountability for the death of a minor, regarding their disallowing blood transfusion as involved in the JW church, not allowing this procedure on their own theological understanding, so that we see that in the future, the Brazilian justice system is expected to adopt a definitive position upon which of the rights guaranteed by our Constitution, in theory are the most important; bearing upon a case like this; the right to life; the (social) entrenchment clause, or the right to religious freedom? This is considering in the afore-cited situation, that religious belief was a determining factor by which life was not saved.

Reconhecimento e apoio ao movimento dos Ex-TJs do Ceará Publicada em: 29/11/2010 Desde a realização da reunião do CRDHDR em Fortaleza (CE), ocorrida em 15 de dezembro de 2009, no auditório Murilo Aguiar, da Assembléia Legislativa do Estado do Ceará, pudemos ter conhecimento acerca, entre outras questões, da denúncia então apresentada pelo senhor Sebastião Ramos, acerca da discriminação sofrida pelos ex-Testemunhas de Jeová (TJs), as quais face uma orientação da igreja, há uma imposição aos desassociados e aos dissociados, de um “isolamento social”, ou seja, há a orientação por parte da organização religiosa, que seja evitado todo e qualquer contato com as pessoas que porventura foram expulsas ou que voluntariamente saíram da igreja, mesmo que sejam familiares e atingindo inclusive menores de idade, isso com base em interpretação própria, amplamente divulgada junto aos seus membros. Vale lembrarmos que esta determinação da igreja, é também aplicada em todos os países onde a mesma está presente, e no caso do Brasil, entendemos que existem duas questões a serem consideradas, onde de um lado, há a garantia constitucional da liberdade de crença e de pensamento, e de outro; também no mesmo Texto Constitucional e na legislação infraconstitucional, além das Declarações e Acordos Internacionais subscritos e referendados pelo Brasil; existem as garantias de que o fato de se ter ou não uma crença, ou de mudar de religião, não pode ser objeto de qualquer ato discriminatório por conta destas eventuais opções. Assim sendo, diante dos fatos, não podemos formar outro juízo, senão o de que toda questão denunciada pelos ex-TJs do Estado do Ceará, se enquadra sem sombra de dúvidas, como sendo exemplo claro e inequívoco de que os mesmos estão sendo vitimados por práticas intolerantes, na medida que são alijados de um convívio social normal; principalmente com familiares; provocando-lhes sofrimentos e seqüelas emocionais que não podem ser mensuradas, e que são motivados pelo fato de apenas não estarem mais na religião, não comungando com suas idéias e princípios. Como temos acompanhado ao longo deste ano de 2010 os acontecimentos decorrentes desta situação, consideramos necessárias e cabíveis, todos as ações que foram e estão sendo trabalhados pelo grupo de ex-TJs na capital cearense, as quais enumeramos: Links do acompanhamento: http://www.dhdiversidadereligiosa.com.br/noticias/not023.htm http://www.dhdiversidadereligiosa.com.br/noticias/not076.htmhttp://www.dhdiversidadereligiosa.com.br/noticias/not090.htm - Denúncia dos fatos junto ao Ministério Público do Estado do Ceará, com robusta apresentação de provas; - Apresentação da denúncia junto aos organismos de defesa dos Direitos Humanos (Conselho Estadual de DHs – Comissão de DHs da Assembléia Legislativa do Estado, Comissão de DHs da Câmara de Vereadores de Fortaleza, este CRDHDR, etc); - A realização de diversas manifestações públicas ordeiras e na forma da lei, tais como , atos públicos; colocação de outdoors e de faixas; entrevistas em diversos meios de comunicação (rádios, jornais, tvs e outras mídias); - Participação e realização de audiências públicas, com a presença de autoridades da esfera federal, entre outras, onde os fatos foram relatados, sob o acompanhamento da sociedade e cobertura de órgãos de imprensa, inclusive estatais; - Divulgação junto a ex-TJs de todo o país e da comunidade internacional, do andamento da discussão junto à justiça brasileira, bem como , das repercussões, solidariedade e até o recebimento de críticas através da internet, bem como , ameaças ou intimidações anônimas. Face toda esta mobilização, reiteramos nosso conhecimento acerca de alguns desdobramentos decorrentes, a saber: - No âmbito jurídico: 1º - Aceitação e encaminhamento da denúncia por parte do Ministério Público do Ceará; 2º - Instauração do processo que tramitou na 6ª Vara Criminal da Comarca de Fortaleza ; 3º - Após manifestação dos representantes da igreja então citados no processo, decorreu que a ação foi para a apreciação da 1ª Câmara Criminal do Tribunal de Justiça do Ceará (TJCE); 4º - Em 31 de agosto de 2010, a 1ª Câmara Criminal, se pronunciou pelo trancamento da ação penal, em especial por uma questão técnica, manifestada pelo entendimento de que, quem deveria haver sido representado na ação, não seriam os Anciãos representantes da igreja no Ceará, mas sim, a comunidade eclesial da igreja nacionalmente, visto a constatação de que os óbices relativos ao “convívio social e familiar” decorrem de um entendimento e determinação da congregação nacional, atingindo portanto a todos os Ex-TJs no país, o que não inviabilizaria uma nova discussão judicial sobre a questão; 5º - A Procuradoria de Justiça do Ceará, promoveu no dia 26.10.2010, a interposição de Recurso Especial, que em sendo admitido, levará a questão a ser apreciada pelo Superior Tribunal de Justiça – STJ, em Brasília. - No âmbito social: 1º - O conhecimento por parte da sociedade em geral, da existência desta situação, a qual era somente sabida pelos membros e ex-membros deste segmento religioso; 2º - O reconhecimento e a solidariedade de organizações da sociedade e lideranças de outras religiões, bem como de representantes de diversos segmentos do setor público, da seriedade dos fatos apresentados; 3º - A partir destas ações dos Ex-TJs de Fortaleza, que se constituem num marco histórico, pois nunca antes havia este assunto sido exposto junto à sociedade em geral, decorreu uma repercussão nacional e internacional, onde diversas pessoas que se encontram na mesma situação passaram a exortar e ao mesmo tempo se solidarizar com todo o grupo; 4º - Ainda sobre a repercussão destes acontecimentos, em diversos sítios da internet no Brasil e no exterior, estão sendo publicados e reproduzidos artigos sobre a questão, além da atualização destas informações sobre o andamento do processo no Brasil; 5º - A consciência geral por parte de vários segmentos da sociedade, da justa motivação do grupo de Ex-TJs, que ensejou o início de toda esta mobilização e a busca dos meios judiciais. - Manifestações contrárias: Tendo o Sr. Sebastião Ramos, assumido uma posição de vanguarda em todo o movimento, em especial no andamento do processo judicial e na divulgação dos fatos, desde então, além dos apoios, também tem recebido e sido objeto de manifestações contrárias, relatadas pelo mesmo e confirmadas pelo grupo de ex-TJs, abaixo enumeradas: 1º - O recebimento de ameaças por membros de sua então comunidade, e por pessoas via internet; 2º - Acompanhamento nos eventos públicos promovidos pelos ex-TJs, em especial nas pacíficas manifestações, fazendo registro fotográfico dos atos públicos, bem como das faixas e dos outdoors postados em várias partes da capital cearense, que faziam alusão ao caso. 3º - Intervenção de dois integrantes das TJs em manifestação pública do dia 13 de maio de 2010 na Praça do Ferreira, centro de Fortaleza (Abolição da Escravatura), promovida pelo Fórum Cearense da Diversidade Religiosa; apoiador da causa; com gestos agressivos exigindo que a denúncia teria que parar; 4º - Pessoas se dizendo advogados da Torre de Vigia, fotografaram faixas colocadas em residências de amigo da causa, indagando ao proprietário de forma intimidatória, onde existiriam outras; 5º - Um afastamento ainda maior dos familiares e amigos ainda membros da instituição religiosa. Diante destes fatos, decorreu que o Sr. Sebastião, de forma preventiva, terminou por buscar ser cadastrado no programa de proteção de testemunhas da Secretaria de Direitos Humanos – SDH, ministério federal. Salientamos ainda que, um dos principais apoios institucionais e jurídicos que o grupo de ex-TJS tem recebido, vem ser do Escritório Frei Tito de Alencar, que é vinculado a Comissão de Direitos Humanos da Assembléia Legislativa do Estado do Ceará, o qual vem acompanhando o caso. É interessante consideramos que toda esta questão possui uma característica única, no campo da intolerância por motivação religiosa, representada pelo fato de se manifestar não de membro ou de um segmento religioso com relação à outra expressão religiosa, como é mais comum em nosso país, mas sim, de um grupo com relação a seus ex-membros.
