I dealt with a similar case where the kids (12 years old) were mutually engaged in sex together. The police cited "Romeo and Juliet" statutes and no charges were filed. The parents were counseled to keep the kids apart and get them some needed counseling. The elders agreed with this.
In another case, one party was 19 and the other was 15. Authorities took it serious and criminal charges were considered, until both were interviewed. The 16 year old was too young to consent, but the case was still dropped and it "went away". The parents of the 16 old were pretty upset but the local DA refused to escalate the case, probably due to the extreme immaturity of the 2 kids. These things are not always black in white in the eyes of the law.
