Confidentiality and the elders.

According to State of Washington v. Martin and Hamlin the following is the criteria:
The earlier Court of Appeals, Division I, case of State v. Buss53
announced three requirements which must be satisfied before communications
between a member of the clergy and a penitent can be considered privileged
under RCW 5.60.060(3): (1) the clergy member must be ordained;54 (2) the
statements must be made as a "confession . . . in the course of discipline
enjoined by the church";55 and (3) the penitent must be constrained by
religious obligation to make the confession.SO. 1. Ordained ministers count.
2. As long as it is stated as a confession to the Ordained minister they are legally bound to keep it private. (Does this happen? No because most witnesses do not state it as such. They do not walk into the the elders and say, I have a confession to make and as your paritioner you are bound by law to keep this confidential.)
3. This is where it gets tricky: It would depend on how you define CONSTRAINED!! Websters: forced, compelled, or obliged.... SO it would depend on how the court sees your case. Did you feel forced, compelled or obliged to confess?? I would say most JW's would have a good argument to say that yes they did. Plus the WT society doesn't want to pay tons of court costs to argue a single definition just to see which way the court would lean. So they will respect your wishes if you state your case in this way.
Most poor JW's though do not realize they have this option or think it is automatically invoked. They ask to speak to an elder and although they may say "I have been smoking" or "I committed fornication" unless they state it as a confession, they arent' covered because unlike Catholics, JW's do not have a confessional or any other formal way of confession. As far as the elders are concerned it is a regular JW speaking to an older, wiser JW. However if everyone preceeded thier statement with the statement that "What I am about to tell you is a confession from a congregation member to an ordained minister and is therefore priviledged", then if the elder if he told anyone other than the standard JC committee could very well be sued for slander if the confession was spread around.

You may want to go out in the dark with a rented uv light or a black light to see if you can see it that way. Jewelers use UV lights to look at gemstones so it is possible it would react to it. I would call a local jeweler for more ideas.

New Here, My Personal Story

my little sister brenda converted about 30 years ago and raised two sons in the truth as she called it.
one boy, mason, is still being raised as a jw (he is 15) and my other nephew, aaron, left the organization on his 18th birthday.

My daughter is in surgery....
by Mum inmy daughter, rebekah, has had persistent, debilitating headaches for about four years now.
as i write, she should be in surgery.
she is having surgery for chronic sinusitis and a deviated septum.

After 18months I get called on - Elder confrontation.
by wozadummy infirstly i will acknowlege this may be long please bear with me.. not all written here will be exactly in the sequence we discussed things, for we talked for some time at my door.. he was my former book study conductor and i still think he has good qualities that i see lacking in so many elders, but as you will see the wts mindset is like concrete in his mind.. i am writing this not to brag but to emphasise and highlight the disgusting mindset of the wts and it's leaders and members.. here we go - some may know that my wife was molested as a child for some time by her elder father.
when we married some years ago it did not take long for her to open up to me about what happened to her and needless to say we struggled with this, and eventually told the local elders what happened to her as a child.. we only went this path after she tried to get him to confess ,which he did'nt and so we followed what we thought at the time was the theocratic way and went to the elders ,and please note we sincerely wanted him to repent so he could get everlasting life.
he denied all and so followed years of heartache for my wife along with her family tormenting her and eventually abandoning her, even by at least one of her sisters whom my wife also witnessed getting done by the father though not as bad ,and my wife even as a kid tried to protect her younger sisters.. ok there is the usual wts crap "we have no witnesses" even though my wife called out to jehovah to stop him as he did this for years.

Sad News Orangefatcat's husband died this morning.
by orangefatcat inthis is one of the sadest days in my life, my beloved husband marco passed away this morning at 5:15 am.. it has been a dreadful day.
but my dear friend was with most of the day while we went togerther to make funeral arrangements.. that was really hard on me.
i have done nothing but cry and cry all day, i finally fell asleep a few hours ago while my friend diane was here and she let me sleep.

I Miss My Parents ....

i've been here long enough to understand the love/hate relationship we've all had with our moms and dads.
for some, forgiving and forgetting sins of omission and commission is not possible.

Same here. Mine aren't really gone, they just will have nothing to do with me. I know they love me and miss me as much as I do them. Hang in there. The way Gumby put it is truly poetic. I can't top that, but I am here for you none the less. Try and have a good weekend.
