Legal wrangling concerning the Governing Body today from my mom.

She stated that the attorney handling her estate, because of Florida law could not take the "death requests form, from the society" because of the case concerning Terry Shiavo. (The Attorney handling my mom's case is not a witness and she was furious that she was asked to sign a document stating that if the Governing Body changed their minds on something this would apply to her.

What is strange is that an outside attorney would have a document like this. Is anyone aware of this?

She was outraged and said "absolutely not".....She then informed me that she viewed the governing body as OK to distribute the news of Paradise among other things, but the policy changes were in her mind the same as "false religion", and won't accept it.

If I can get a copy of this document I will post it. Possibly Monday or Tuesday.

    What do you thinK?

Interesting can't wait to see the copy to see what it contains. Very very interesting.

I will make sure and get a copy of this form and post it here. I don't know that she will have a copy Monday because she refused to sign it, but will do my best to get it.

    What form is this, exactly?

I don't know what the form is. It was one she was asked to sign should she become unable to care for herself, and any new decisions or changes by the Governing Body were to be followed.

    Can you believe this?

I think the attorney knows more about the JWs that she has told you. Hmmm.... :) Wait a minute, I am confused. Your MOM refused to sign? or the attorney? Who made the false religion comment?

Sounds like DPA the Society "encourages" all its members to have. It is a durable power of attorney, but not all states accept the same language.

I'll have to ask for one and read the fine print. And yes, it is unconscienceable for the GB to insert language of that sort in a legal instrument.

Could someone spell this out more clearly? What does this power of attorney do?

    Hi Zack,

I'll give you some background. I was the Executor of her Estate up until June of last year until some DO encouraged her to shun me. It became really ugly, but eventually she couldn't hold out and things have somewhat normalized. During that time she increased the amount going to the society but has since changed her mind and put it back to where it was originally. Her attorney must have sent her a copy.

I think the society must of sent her attorney some form for her to sign, which I repeat she refused to do, and was quite angry about it.

This is what I'm looking to get a copy of. It was worded that if she were to go into a coma or were unable to make decisions for herself, that any changes from the Governing Body were to be applied in any decisions about her life.

This is not the same form they use for a witness to decide how long to prolong life or not to. She already has one of those filled out and it did not apply here in Florida. She had to fill out a 10 page questionnaire for that.

This was a totally separate document that she had never seen or heard of before.
