Legal wrangling concerning the Governing Body today from my mom.

    According to her attorney the state of Florida over rides the medical DPA form provided by the WTBTS for Florida, so she had to fill out 10 pages of questions.

    I talked to her again about the other form. It was prepared by the attorney himself, not the WTBTS. It was a single page allowing any medical policy changes by the GB that take place to be followed if she were not capable of making the decisions for her self. That's the form she wouldn't sign.

    restrangled, I wonder if Legal in NY is aware of this requirement in FL. Every JW's form would be invalid then.

    I wonder if my mom could be mistaken and not realize that it is actually from WTBTS to cover the situation in Florida.

    I don't know because she didn't sign it, so therefore didn't get a copy.

    Every JW's form would be invalid then.

    They probably don't want to alarm the JW's. Just let them think everything is okay and take these
    cases when and if they come up.

    Am I to understand that Doctrinal or Policy changes that get voted in by the Governing Body would
    automatically be applied to your mom if she is incapable of asking what she wants?

    That's like making the GB a back-up lawyer for her.

    So, if they need her money, and they decide that in cases like hers, they should pull the plug, they
    could do it, because it was her wishes? If they decide to allow blood, she'll get it?

    Thats what my mom understood so she refused to sign it. She is totally against any blood whats so ever, so it ticked her off.

    Is this situation a quirk in Florida state law? I ask this because If I remember correctly, the Florida State Legislature passed some kind of bill in response to the Terry Shiavo fiasco. The bill could have had a bunch of screwy clauses and provisions in it regading estates and churches involved. This is not something that I have ever heard of out here in California.

    restrangled, all I can say is that the WTS is very careful about legal matters that can come back and bite them in the rear. I can't see them going against the state of Florida without seeking a legal remedy first. It could be worth a call to the service desk in NY by her lawyer to find out--lawyer to lawyer.
