My stance is to always look forward.
If this is an issue of child abuse, it is no where near the same as a pube in a restaurant.
So, you're saying that all people should be affected the same legally by a pube in their food?

Yes, sue. (I work at Home Depot.) ;-) That's up to you. Were the boards unsafely stacked? Were there employees close by for help?
Personally, I wouldn't sue unless I felt the situation was unsafe.
But still, getting run over by a car and finding a pube in your ravioli do not equate.

That's rather subjective, isn't it?
Yes. Legally.
However if we are looking at this from a legal standpoint other illegal actions may be involved. The restaurant would come under the scrutiny of the health department or other legal entities.
A child abuser may have additional charges. ie. Risk of injury, Indecent exposure or the like. Multiple charges for multiple occurences
But if it is a one time, one accusation charge, then legally it should be dealt with the same.
Everything is subjective in this world.
Actually, a female employee walked with me to the restroom. I went in and checked my leg. It hurt and it has a seven or eight inch long scrape, but I'll live. I told her it was ok.
She then went back and put everything back the way it was. I said nothing, but later I said to my husband: "You know, what if I was a little kid flipping through those boards, that stuff would have landed on my head and I could have been really hurt".
