    Thanks AnnOMaly. What I don't get is, if there were truly "irregularities in the proceedings of the court" and "errors in law, occurring at the trial" etc, then why weren't these flagged by the Watchtower attorney at the time? Why, all of a sudden, are there problems with how the trial was undertaken?

    That aside, it's interesting to note that (against my prediction) the Society is hell-bent on pursuing this appeal, even though it is (as of this moment, I assume) inhibiting them in their ability to sell property.

    If they do lose the appeal, it'll open the floodgates, and they'll want to avoid that, come hell or high water.

    cedars, the WTS attorneys were objecting and filing motions left, right and center (as was the Plaintiff's side). If the Court overrules those objections or denies/grants motions the Defendants disagree with on legal/precedent grounds, I guess the latter would claim there are irregularities in court proceedings and that the appeal judges should take a second look at these.

    I thought the condition was that they could not sell property without notifying the court, not that they could sell property at all.

    The ban on WTS property sales applies only to its Brooklyn holdings. The Society can still sell kingdom and assembly halls without court permission.

    Its not much of a hinderance to ask your lawyer to file a motion. At most it adds a few weeks to the process of selling a building.

    Diest, yes but time is money - a delay of a few weeks could cause problems. And you're assuming the motion is accepted.

    The Watch Tower Society doesn't enjoy being answerable to anyone when it comes to its financial affairs, so at the very least it's a humiliation to have to seek permission to sell their own property.

    Not really surprising, the WTS lawyers are not idiots.

    They know that losing this case and its appeals would indeed open the floodgates.

    Expect them to try absolutely anything and everything to overturn the decision or at least reduce the payments, all the while dragging out the procedures as much as possible.

    The WTS has a "free" and highly motivated legal team. They are well suited to fight a war of attrition.
