    There are all sorts of legal rules concerning searches and seizures under the First Amendment. In this case, a physical patdown and search should be their first priority when they gained custody of the suspect. I made certain I would never be exposed to criminal law after working in college as a abuse allegation investigator in the NYC jails. My early life was hard. I wanted to be surrounded by nice people and things.

    Unless you practice in the area or are taking a Criminal Procedures course at the moment, it is complex. It changes frequently, too.

    Something very strange happened. My top goals would be: 1. security concerns 2. obtaining information from a living suspect.

    When faced with immediate threat to life I think responding with force is acceptable, including lethal force. In my case, if someone threatens my life or family my first response will be to escape or extract. If that’s not a viable alternative then I’ll respond with whatever force is at my disposal without regard for harm to the assailant. I don’t expect anything more or less from anyone else.

    I agree with that. If the FBI agents were attacked with lethal force and it was reasonable to believe they would be killed or severely injured, then I think they took the appropriate action. What else could we have expected them to do under the immediate circumstances surrounding the Todashev's death?

    Regarding the title of this thread, yup, that is so. Regarding all the other insinuations, it's opinion and nothing more. Simon, just because you may think you're on to something, it doesn't mean you are correct.

    Face it........ it's just the first reporting. We can jump to conclusions based on information that may not be true or we can see what comes out. One thing you can count on is that there are three different police agencies involved with this particular incident....... I doubt seriously if anyone is going to get away with painting a picture.

    Lets also keep in mind that this person had a violent background, simple things like a minor fender bender or losing a parking space became violent confrontations, followed by arrests. Not to mention, based on his verbal confession, the killing of three adults in a drug ripoff gone terribly bad. As far as only being 160 pounds......with training and actual experience in fighting and armed with a knife in close quarters he was extremly dangerous. The FBI agent had cuts to his face which might mean they were in close quarters perphaps fighting over the knife. I don't mean to speculate but my paranoid tendenices are not ramping up.............the story will come out.

    Giordno if what you said is true then some needs to lose their job. For one thing they did not secure the suspect and two they nearly killed a fellow officer because despite what you see in movies you don't shoot into a fight ever becuase you might hit the wrong person and then you made things way worse.

    Yes, I find it odd that he wasn't taken into custody after the information he provided. Perhaps he was being taken into custody when the attack occurred.

    Marvin - sorry, your boat theory is way off balance.

    The cops didn't know if the guy in the boat had a bomb? They should've just asked the guy who owned the boat - after all, he walked up, lifted the tarp and oh my goodness! He looked inside.

    He did it without firing 100 rounds into the boat first. From what the boat owner said - there was blood on the boat. This indicates an injury. The man was lying prone in the boat - he didnt' rise up and shoot, or scream, or beg or plead. He was obviously out of it and injured. If you wanted to take a guy alive - you wouldn't shoot 100 rounds into a boat with an injured guy was lying. Then if you really wanted to tell the truth - you wouldn't go on national television and say the suspect shot himself in the throat trying to avoid capture - and then come out and acknowledge in public that there was no gun in the boat and thus the suspect could not have shot himself in the throat.

    Any wonder why nobody is buying so many statements made by officials? sammieswife
