    Attorneys are considered 'Officers of the Court'. If their very status is illegal, then how can they rightfully become Officers of the Court? This is just another red herring argument. No illegal immigrant can attend law school. Getting into law school itself requires a background check. Should they get past that requirement, they can get a student visa just as soon as they are admitted.

    Qualifying for a Student Visa

    The Immigration and National Act is very specific with regard to the requirements which must be met by applicants to qualify for the student visa. The consular officer will determine whether you qualify for the visa. Additionally, applicants must demonstrate that they properly meet student visa requirements including:

    Have a residence abroad, with no immediate intention of abandoning that residence;
    Intend to depart from the United States upon completion of the course of study; and
    Possess sufficient funds to pursue the proposed course of study.

    Applying for a Student Visa

    As part of the visa application process, an interview at the embassy consular section is required for visa applicants from age 14 through 79, with few exceptions. Persons age 13 and younger, and age 80 and older, generally do not require an interview, unless requested by embassy or consulate.     During the visa application process, usually at the interview, an ink-free, digital fingerprint scan will be quickly taken. Some visa applications require further administrative processing, which takes additional time after the visa applicant's interview by a Consular Officer. Also, because each student's personal and academic situation is different, two students applying for same visa may be asked different questions and be required to submit different additional documents.
    Required Documentation

    Each applicant for a student visa must submit these forms and documentation as explained below:

    Form I-20A-B, Certificate of Eligibility for Nonimmigrant (F-1) Student Status-For Academic and Language Students or Form I-20M-N, Certificate of Eligibility for Nonimmigrant (M-1) Student Status for Vocational Students. You will need to submit a SEVIS generated Form, I-20, which was provided to you by your school.You and your school official must sign the I-20 form. See the previous section for SEVIS information.
    Online Nonimmigrant Visa Electronic Application, Form DS-160. Visit our DS-160 webpage to learn more about the DS-160 online process.
    A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States (unless country-specific agreements provide exemptions). If more than one person is included in the passport, each person desiring a visa must complete an application.
    One (1) 2x2 photograph. See the required photo format explained in Photograph Requirements;
    A MRV fee receipt to show payment of the visa application fee.
    The SEVIS I-901 fee receipt.

    All applicants should be prepared to provide:

    Transcripts and diplomas from previous institutions attended;
    Scores from standardized tests required by the educational institution such as the TOEFL, SAT, GRE, GMAT, etc.;
    Financial evidence that shows you or your parents who are sponsoring you has sufficient funds to cover your tuition and living expenses during the period of your intended study. For example, if you or your sponsor is a salaried employee, please bring income tax documents and original bank books and/or statements. If you or your sponsor owns a business, please bring business registration, licenses, etc., and tax documents, as well as original bank books and/or statements.

    Well, probably true for US Citizens- but an illegal immigrant hasn't made a contractual agreement to be under US laws- depending on the State statues wording, it might be found that the school has no legal (jurisdiction) need to provide a background check for an illegal--

    I had no background check. They ask some questions on the application but you do not sign an oath. So many foreign lawyers work here. All the large firms when I first graduated (150 lawyers) are now in the thousands of lawyers. Foreign lawyers are needed b/c of globalization. This is no big deal.

    The FLA newspaper and politicians and, especially you, have no standing to resolve it. It is easy to see a "test" case.

    I refuse to hate people b/c of where they are born. It is not easy to be admitted to law school and to finish. If it is at this point, he finished the FLA bar exam successfully. No mean feat these days.

    This country would be no place were it not for its immigrants. Tell me how Hamilton was such a key figure in the Founding of this country and its first administration, yet he was foreign born and a bastard. We love Nordic immigrants but not colored ones.

    I don't believe I am one note in the same manner as you. There is no agenda for me. Daily we hear of some so-called travesty that is NOT one.

    To gain admittance to law school, you have to explain even your traffic tickets and list them. The Bar will probe more further. Hamilton was born in the West Indies, a British colony just like the original 13. At the time he was simply viewed as a "colonial", as was everyone else living outside of Great Britain in one of her colonies. I don't know what you are getting at by "Nordic". Nordic means Scandinavian, only a small portion of immigrants to the US. Germanic would cover the Germans, and Anglo-Saxon, Scots-Irish, Irish would be other categories. Perhaps you mean northern European? That would certainly account for the first wave of immigration, followed by southern European and Eastern European. Nowadays there are plenty of immmigrants from Asia, Africa, and Latin America. Try to speak for yourself when deciding on whether or not to like these new immigrants. "We" is a vague pronoun because it could mean everyone in the country (which of course means these immigrants hate themselves), or limited to a group such as the "Nordic" one you mentioned earlier. As one of these new immigrants of "color", I've been very welcomed here. Maybe you're hanging out in the wrong circles.

    Not to get off the primary topic, but why on god's green earth did this person not simply apply for citizenship long before getting to the point of asking to be admitted to the bar?

    They don't teach them how (and why) to do this in Florida Law School?

    Good Question James Woods! I'll let the lawyers here explain why he didn't do that. It is obvious that this person didn't qualify for a foreign student visa, so it sure makes law school look fishy to me- admitting a student who was breaking immigration law and could be deported at anytime. I think he has someone higher up protecting him.
